COLE to Caleb HOOTEN, Craven Co., NC 21 Sept. 1836 This Indenture made and executed this 21st day of September A. D. 1836 by and between James C. COLE of Newbern of the one part and Caleb HOOTEN of the other part. Witnesseth that he said James C. COLE for and in consideration of Seventy five Dollars to him in hand paid by Caleb HOOTEN at and before the delivery of there presents the receipt whereof is hereby acknowledged and from the same and every claim therefor the said Caleb HOOTEN is hereby released and discharged hath given grant bargain and sell unto the said Caleb HOOTEN a price of land situate in Craven County near the Town of Newbern bounded as follows, beginning at a lightwood post formerly BRYANS now FORBES corner on the North side of Queen Street and at its junction with the Neuse Road running thence with the Neuse Road due West six poles and five feet six inches then North one fourth of a degree West twelve poles and eleven feet thence East six poles five feet and six inches to FORBES line then along FORBES line to the beginning containing half an acre with all and singular the appurtenances. To have and to hold the said piece of land and its appurtenances herein before bounded and described unto the said Caleb HOOTEN his heirs and assigns forever and the said James C. COLE for himself and his heirs to and with the said Caleb HOOTEN his heirs and assigns doth hereby covenant and that he is well seized of a good and indefeasible estate in fee simple to the premises hereby granted and hath good right and lawful authority to give grant bargain and sell the same as aforesaid, that said premises are free and clear of all encumbrances whatsoever ate that he the said James C. COLE and his heirs shall and will by there presents forever warrant secure and defend the said premises and appurtenances hereby granted unto the said Caleb HOOTEN his heirs and assigns against the lawful claims of all persons whatsoever. In testimony whereof the said James C. COLE hath thereunto set his hand and seal the day and year first above written. J.C.
