This Indenture made and executed this twenty fourth day of November in the year of our Lord one thousand eight hundred and forty seven by and between Robert Hunter of the County of Duplin and State of North Carolina of the first part, Sarah J. Dunn of the Town of Newbern and State aforesaid of the second part and William Dunn of the Town and State aforesaid of the third part, Witnesseth whereas a marriage by God's permission is intended shortly to be had and solemnized between the said Robert Hunter and Sarah J. Dunn, and whereas the said Sarah J. Dunn is possessed of and justly entitled to the following Negro slaves that is to say, Tina, Martha, Susan, Lemuel, William, Hannah, Mary, Eliza, Peggy, Jane, Caroline and Louisa, and whereas it has been stipulated and agreed between the said Robert Hunter and Sarah J. Dunn that the said Sarah J. Dunn shall continue to hold exercise and enjoy all the beneficial rights of ownership in and over the said slaves and their future increase notwithstanding her intended coverture and that the same shall be except from the control or dominion of the said Robert Hunter the intended husband of the said Sarah J. Dunn and not liable in his debts, contracts or engagements. Now in consideration of the said intended marriage and in pursuance and performance of the agreement entered into upon the treaty of the said marriage and also for and in consideration of one dollar he the said William Dunn unto each of the aforesaid parties the said Robert Hunter and the said Sarah J. Dunn in hand paid at and before the sealing and delivery of these presents the receipt whereof is herby acknowledged and the said William Dunn released from all demands and therefore the said Sarah J. Dunn with the privets and consent of the said Robert Hunter her intended husband testified by his being a party to and sealing and delivering these presents, hath granted bargained and sold and delivered and by these presents doth grant bargain sell and deliver and the said Robert Hunter hath released ratified and confirm and doth hereby release ratify and confirm to the said William Dunn his executors administrators and assigns the said Negro slaves Tina, Martha, Susan, Lemuel, William, Hannah, Mary, Eliza, Peggy, Jane, Caroline and Louisa and all their future increase. To have and to hold the said slaves above named and all their future increase to the said William Dunn his executors administrators and assigns upon such trusts that and for such interests and purposes as are hereinafter declared and expressed concerning the same that is to say In trust for the said Sarah J. Dunn her executors and administrators until the said intended marriage shall be had and solemnized and from and immediately after the solemnization thereof to the use of the said William Dunn his executors and administrators in trust that he shall permit the said Sarah J. Dunn during her natural life and notwithstanding her coverture to have the possession and receive the hires issues and profits of the said slaves and their future increase and the same to use apply and dispose of at her sole with pleasure and discretion in such manner and to such interest as she the said Sarah J. Dunn may think proper to the intent that neither the said slaves and their future increase nor the hire in profits of their labor nor any part thereof shall be under the central management or disposal of the said Robert Hunter. Nor be in any manner or way liable to his contracts debts or engagements and from and immediately after the decease of the said Robert Hunter should the said Sarah J. Dunn be then living, In trust that the said William Dunn his executors or administrators shall surrender assign and deliver over the said slaves and their increase to the said Sarah J. Dunn her executors administrators and assigns forever, but in case the said Sarah J. Dunn shall not survive the said Robert Hunter then in trust that the said William Dunn his executors or administrators shall grant assign and set over the said slaves and their future increase to such person or persons and for such interest and estate as the said Sarah J. Dunn by her last will or by any writing in the nature of a last will by her executed in the presence of two credible witnesses shall give limit direct or appoint the same to be granted conveyed and set over which said last will or writing the said Robert Hunter hereby agrees and consents that the said Sarah J. Dunn notwithstanding her coverture shall have full power and authority to make and execute and for want of such last will and testament or writing in the nature of a last will and testament then in trust that the said William Dunn his executors or administrators shall grant and convey the said slaves and their increase to such child or children of the said Sarah J. Dunn their executors administrators and assigns forever. Provided always and it is hereby further agreed and declared by and between the said Robert Hunter, Sarah J. Dunn and William Dunn and it is the true interest and meaning of these presents that the said Sarah J. Dunn notwithstanding her covertures shall have full power liberty and authority and it shall and may be lawful to and for the said Sarah J. Dunn by any deed or deeds writing or writings to her by her subscribed sealed and executed in the presence of two or more witnesses to revoke or alter all or any of the trusts herein before mentioned limited and declared of touching and concerning the said slaves and their future increase and by the same deeds or writings to create limit and appoint any new or other trust or trusts of or concerning the same or of so much or such part thereof whereof any such revocation shall be made any thing herein contained to the contrary thereof in any wise notwithstanding and the said Robert Hunter for himself and his heirs doth covenant to and with the said William Dunn his executors and administrators that he the said Robert Hunter will not make way with dispose of or injure any of the property hereby settled no will he suffer the same or any part thereof to become chargeable with or to be effected by his debts or engagements of any sort, and that he will permit the said Sarah J. Dunn during the marriage freely to exercise the power of appointment herein declared and reserved without control and that no person claiming under him shall hinder obstruct or control any disposition limitation or appointment made by virtue thereof. In witness whereof the said Robert Hunter, Sarah J. Dunn and William Dunn have hereunto set their hands and seals the day and year first above written. R. J. Hunter Sarah J. Dunn Will. Dunn State of North Carolina Before me the subscriber one of the Judges of the Superior Court of Law and Equity in and for the State aforesaid Sam'l A. Dunn the subscribing witness to the foregoing deed from R. J. Hunter, Sarah J. Dunn and William Dunn proved the same in due form of law to be the act and deed of the said parties for the purposes therein mentioned. At Newbern 17th Jan'y AD 1848.
