Mason http://www.genrecords.net/emailregistry/vols/00023.html#0005630 March 20, 2019, 8:04 pm Register of Deeds Craven County, NC Bk. 46, p. 181 Indenture & Marriage Contract: Richard GRANT of Craven Co., NC & Louisa FIFE, widow of William FIFE & Jesse FIFE of New Bern, NC 6 Jan 1829 This Indenture made and executed this 6th day of January AD 1829 between Richard GRANT of Craven County of the one part, Louisa FIFE widow of William FIFE of Newbern of the second part and Jesse FIFE of Newbern aforesaid of the third part. Witnesseth that whereas a marriage is agreed upon, and by the blessing of God is intended to be Solemnized between the said Richard GRANT and Louisa FIFE, and whereas the said Louisa FIFE is seized in fee of a certain tract of land containing one hundred acres situate on Batchelor’s Creek in Craven County, also of a lot of ground lying on Queen Street in the town of Newbern distinguished in the plan of said town by the number two hundred and eighty five (no. 285) with the building and improvements; and whereas the said Louisa FIFE is possessed of and justly entitled to the following personal property in the household and kitchen furniture in the house where she at present resides, and three hundred and fifty dollars due by notes now in her possession & also one undivided share in the personal estate of the said William FIFE, deceased, and whereas it has been stipulated and agreed between the said Richard GRANT and Louisa FIFE, that she the said Louisa FIFE shall continue to hold exercise and enjoy all the beneficial rights of ownership in and over the said property notwithstanding her intended coverture and that the same shall be exempt from he control or domination of the said Richard GRANT the intended husband of the said Louisa FIFE, and not liable for his debts and engagements. Now therefore in consideration of the premise and of one dollar by the said Jesse FIFE to the said Louisa FIFE and Richard GRANT in hand paid the receipt where of is hereby acknowledged and they and each of them herewith fully satisfied contented & paid the said Louisa FIFE hath given granted bargained sold assigned & set over & doth hereby release and confirm unto the said Jesse FIFE his heirs executors administrators & assigns the real and personal property herein before described. To have and to hold the said lot & land to the said Jesse FIFE his heirs & assigns forever & the said personal property to the said Jesse FIFE his executors, administrators & assigns upon the following Trusts that is to say that she the said Louisa FIFE shall at all times during the coverture receive and enjoy to her separate use free from the control of her said intended husband all the benefits, profits and advantages desirable from the use or have thereof and that the said Jesse FIFE his heirs executors administrators or assigns shall at any time and at all times when so directed convey, assign & deliver over the said real and personal property and any part or the whole thereof to any person or persons, and in any manner and for which she the said Louisa FIFE shall by writing under her hand and seal either in the nature of a deed or will direct and appoint and upon the death of the said Louisa FIFE and upon no appointment or direction being mad as aforesaid by the said Louisa FIFE that then the said Jesse FIFE his heirs executors administrators or assigns shall convey assign & deliver over said lands lot & personal property or so much thereof as shall not have been disposed of as aforesaid to such child or children of the said Louisa FIFE as may survive her, or to their legal representative to be held by them as their absolute & indefeasible property.
