I John Benners of the County of Craven and State of North Carolina, being in perfect mind and memory thanks be to God for the same, who calling to mind the mortality of my body, knowing that it is appointed for all men to die do make this my last will and testament. That is to say that first of all I give and recommend my soul unto the Lord my God who gave it and my body I recommend to the earth to be bound in a Christian like manner at the discretion of my executors nothing doubting, but at the general resurrection I shall receive the same by the mighty power of God and as such of my worldly estate which it hath pleased God to blefs me with. I give and dispose of it in manner and form following: That is to say in the first place I give and bequeath unto my beloved sister Elizabeth Howard eleven Negroes during her natural life and at her decease to be equally divided among her grandchildren. Viz: Bella, Lucy, Juliet, Simon, George, Cator, Old Dinah, Pemorial, Ben, Took and Old Tom to them their heirs and apsigns forever. Also, I lend to my sister aforesaid during her natural life one third of twenty two hundred and thirty acres of land on South River called the Golden Grove which shall include the part next to South River and one third part of the cleared land. Also, I bequeath and lend to my sister aforesaid one third part of all my stock of every kind that is on the Golden Grove to her her heirs & apsigns forever. Item. I give and bequeath to my nephew Thomas Patridges seven Negroes, viz: Elec. Walpool, Dinah, Amrica, Canior, Rachel, & Old Jim also one third part of twenty two hundred and thirty acres of land called the Golden Grove which shall included one third part of the cleared land being the most adjoining of his mothers part. Also one third part of all my stock that is on the Golden Grove to him his heirs & apsigns forever. Item. I give and bequeath to my niece Elizabeth Jones eight Negroes, viz: Patience, Little Elec, Sarah, Toney, Old Lu, Jimboy, Bill and Old Sarah also the remaining third part of twenty two hundred and thirty acres of land called the Golden Grove also one third part of all my stock that is on the Golden Grove to her her heirs & apsigns forever. Item. I give and bequeath to my nephew John Benners Herritage one Negro named Steph to him his heirs & apsigns forever. I give and bequeath to his son Lucas Herritage six hundred & forty acres lying near (can’t read jh) ferry and Neuse River known by the name of (can’t read-jh) landing to him his heirs and apsigns forever. Item. I give and bequeath unto Lucas Jacob Benners one Negro man named Ismal to him his heirs & apsigns forever. Also it is my will and desire that my Negro man shall work six months of his time for Lucas Jacob Benners and the other six months each for himself until he acquires two hundred pound cash for which the said Lucas Jacob Benners shall sell him the whole of his time forever and it is my will and desire that he be then absolutely free. Item. I give and bequeath to Lucas Benners, Frances Benners and Sarah Benners (children of Lucas and Sarah Benners) fifteen Negroes, Viz: Old Mingo, Molly, Andrew, little Ben, Mark, little Mingo, Pomona, Tote, Sarah, Ceavar, young Molly, young Ally, Will, Venus, Jinah, to be equally divided among them to them their heirs and apsigns forever. Item. I give and bequeath to Lucas Benners son of Lucas and Sarah Benners, (after the decease of my sister Elizabeth Howard) the one third part of my Golden Grove which I lent to my sister during her natural life to him his heirs and apsigns forever. Item. I give and bequeath to Thomas Patridge and Lucas Benners jnin one house and lot in the Town of Newbern being the one that my sister has a right of dower in near Wm Goods, to them their heirs and apsigns forever. Item. I give and bequeath to my nephew John Vail six Negros, Viz, Jenney, Peter, Isaac, Stater, George, Briston, also one half of a house and lot in the Town of Newbern joining Mrs Garners to him his heirs and apsigns forever. Item. I give and bequeath to my nephew Benners Vail twenty one Negroes: Viz, Old Peter, young Manuel, Quar, Danny, Jacob, Appey, Binah, Abram, Florah, Nancy, Sam, Pop, Harry, yellow Mott, Bill, Old Harry, Old Jenny, Old Jack, Yellonan, young Qeacho, Alfo all my land that lieth between Clubfoot Creek and Long Creek also all my lands on the eastern most side of Long Creek including my mills, also all my other lands that are not other wise disposed of except a piece of about three hundred acres on the west side of Club Foot Creek in Broad Neck also my plantation whereon I live together with all the stock of every kind together will all the plantation tools and utensils of every kind that are upon it. Also all my house furniture (except two silver stands, two silver salt tellars and two silver pepper castors) and except two beds and furniture all to him the said Benners Vail his heirs and apsigns forever. Item. I give and bequeath to Lucas Benners jun, Five hundred dollars cash to him his heirs and apsigns forever and the money to be put out to interest until he arrives lawful age. Item. I give & bequeath to Fanny Benners and Sarah Benners, Daughters of Lucas & Sarah Benners One thousand dollars in cash and two silver stands and two silver salt sellers and two silver pepper castors to be equally divided them to them their heirs and apsigns forever and the money to be put out to interest until they arrive to lawful age or marriage. Item. I give and bequeath to my sister Elizabeth Howard five hundred dollars to her her heirs and apsigns forever Item. I give and bequeath to my nephew Thomas Pattridge five hundred dollars in cash to him his heirs and apsigns forever. Item. I give and bequeath to my niece Elizabeth Jones five hundred dollars in cash to her her heirs and apsigns forever. Item. I give and bequeath to my nephew Lucas Jacob Benners five hundred dollars in cash to him his heirs and apsigns forever. Item. I give and bequeath to my nephew John Vail fifteen hundred dollars in cash to him his heirs and apsigns forever. Item. I give and bequeath to my nephew Benners Vail all the remainder of my cash that is not before disposed of to him his heirs and apsigns forever. Item. It is my will and desire that my old Negro George, Manuel, Old Biner, old Wuner, Sarah and Stephen be all and every of them absolutely free forever as well as any future off spring they may have. Item. I give and bequeath to my old Negro George, to my old Negro Manuel & to Sarah and Stephen all my land in the broad neck on the west side of Clubfoot Creek; Viz. to George one third, to Manuel and Biner, one third and to Wuner and Stephen the other third to them the heirs & apsigns forever. And lastly I nominate and appoint my beloved nephew Benners Vail whole a sole executor to this my last will and testament. Ratifying and confirming this and no other to be my lasat will and testament revoking and disannulling all former wills by me at any time heretofore made.
