CR 028.508.17 - ____. We did none after 1850 and for the ones between 1825 and 1850 only scanned them for any information on previous generations. Some had much more information than others - we got the names, if there were any, any land, etc, if any was noted. The one thing Martha did not do that may have to be done at some point is to make a list of the Negroes involved - Sue did list them. If there was any indication of where they lived by the neighbors or people buying from the estate, we noted it. 1. ANN R. BRYAN March 1818 - THOMAS O. BRYAN, ASA JONES AND SARAH his wife, MARY BRYAN, ALICE BRYAN by their guardian (no name given), JOHN JUSTICE AND MARIA his wife, WILLIAM BRYAN, BETSY BRYAN, MARIA TISDALE and JOHN C. BRYAN 2. ANN BRYAN - 19 December 1769 - 10 Negroes - pretty good size estate - Inventory taken by JON. BRYAN and Wm BRYAN 3. ANN BRYAN - Dec 1811 - petition of THOMAS BRYAN, JOHN JUSTICE and MARIA his wife, STEPHEN B. FORBES and ELIZABETH his wife, SALLY BRYAN, ALICE BRYAN, and MARY BRYAN, infants, by MARY ANN BRYAN their mother and guardian, JOHN C. BRYAN, an infant by his mother and guardian, WILLIAM TISDALE, BETSY TISDALE, and MARIA TISDALE infants by NATHAN TISDALE their father and guardian. NOTE - Often there was more than one folder for the same person. That ANN BRYAN daughter of JOHN C. BRYAN late of Craven died in the year -- - underage and owned property devised by the Will of her father - that the petitioners, THOMAS, MARIA JUSTICE, ELIZABETH FORBES and HARDY BRYAN were brothers and sisters of ANN on the part of her father and SALLY, ALICE, and MARY, her sisters by the same parents; the petioners, WILLIAM, BETSY, and MARIA TISDALE, the children and heirs at law of MARY TISDALE a sister of the said ANN on the part of the father who died before the said ANN viz year 180---. The said HARDY has since died and had a will leaving to his only son J. C. BRYAN. They wish the land to be divided. 4. ASA BRYAN 1781 - PETER FRANKLIN, WILLIAM CARRAWAY, and FRANCIS DAWSON adm of ASA BRYAN - inventory taken 3 June 1782 - 200 acs of land PART of Fore (sic) Negroes, etc. NOTE: I find the word - PART of interesting as it implies he shared them with someone. 5. DARBY BRYAN Sale of property 15 January 1807 - buying among others NANCY BRYAN (she bought most of the estate implying she was the widow), JOHN BRYAN, ANNA BRYAN - inventory taken 16 May 1807 by NANCY (x) BRYAN 6. EDWARD BRYAN 29 July 1758 - Division of Negroes - HARDY and ANN BRYAN - EXEC JOHN BRYAN received Negroes - Primous, Teeners, Hagers and others I can't read; PENELOPE received Negroes ROBIN, Grace and others; EDWARD received Dock, Frank, Carl Jesse ? and others 7. FREDERICK BRYAN Sale by THOMAS GOODING, exec - 17 August 1816 - purchasers among others were MARY BRYAN, JOHNSTON BRYAN Property divided to widow and Kin - widow received 4 Negroes - Virgil, Suck, Bill, and Daniel. JOHN M. BRYAN received Aaron MARY BRYAN received 1 Negroe girl Aymy ? 8. GEORGE BRYAN - 1811 this appears to be GEORGE Sr. - GEORGE AND JOHNSTON BRYAN were executors and stated this estate was of great value - GEORGE had a will and devised to sons FREDERICK, GEORGE, JOHN, and JOHNSTON several tracts of land - he also had a lot in New Bern - lot #399. GEORGE also had other children, MOLSY who has since died instate without issue; SARAH the wife of JAMES HOLLOWELL who has since died leaving JOHN, BRYAN, MARY, and WINIFRED HOLLOWELL her children; and NANCY CLIFTON who is also dead leaving RACHEL, and ELISA CLIFTON her children. GEORGE never gave anything to his daughters - the petitioners, JOHN, BRYAN, MARY, and WINNIFRED HOLLOWAY by their father, and JAMES, RICHARD and ELIZABETH CLIFTON also by JAMES HOLLOWAY - want proceed of the sell of the lot in New Bern. NOTE: The names of Nancy Bryan Clifton are not clear from the above. 9. GREEN BRYAN Sale 15 December 1813 - JEREMIAH MARTIN and ANN BRYAN executors - later THOMAS A. GREEN and ANN WERE administrators - buying were NANCY BRYAN who bought most of the estate. 10. GREEN BRYAN 1826 - HENRY JONES and wife SOPHIA were heirs 11. GREEN BRYAN 1838 - ANN and GREEN BLACKLEDGE petition to divide the Negroes - it appears that ANN was the widow - GREEN was not a BLACKLEDGE, but a BRYAN as shown elsewhere. His first name may have been WILLIAM - this is not clear. 12. HARDY BRYAN 30 June 1764 - to divide 13 Negroes according to the will - signed by JOHN BRYAN, JOHN FRANK and FREDERICK (X) BECTON - 5 NEGROES were sold to a HARDY, NATHAN, and WILLIAM BRYAN 13. HARDY BRYAN 1772 - - WILLIAM BRYAN was the exec - paid to NATHAN BRYAN money to school WILLIAM, ASA ? and EDMUND BRYAN- rather detailed estate records and goes up to at least 1785. There are lots of guardian accounts in here - widow was SARAH BRYAN 14. HARDY BRYAN The above two could be the same person or two different people - 1785 - WILLIAM BRYAN, son of HARDY was bound out to JAMES MCDOWELL - WILLIAM BRYAN, Esq petitioned on behalf of WILLIAM Jr. - by 1793 WILLIAM BRYAN was deceased (the executor). In this folder there was a son JAMES listed as a son for HARDY NOTE: From Sue - These 2 (13 & 14) have to be the same person, but there's some problem with the date for 13, because Hardy must have died after 1772, based on his son Asa's age. I wonder if there was a 1772 document in this folder that really belonged with Hardy, Sr.'s estate, and that threw the date on the label off. 15. HARDY BRYAN 1796 - FREDERICK LANE, THOMAS A. GREEN and JOSEPH LOFTEN - Bond for writ of error - the representatives of HARDY, dec against FREDERICK LANE and LEWIS BRYAN exec of WILLIAM dec who was the EXEC of HARDY BRYAN, dec - it appears the accounts of WILLIAM were off by around $500. NOTE: This indicates Trent River family Note - from Sue - This is Hardy Bonner Bryan, the son of Brig. Gen. William Bryan and Susan Green. 16. HARDY BRYAN 1809 - estate appeared to owe money - DORCUS was the widow - maybe a JOHN COUNCIL BRYAN was the infant - very thick folder but not a lot of good information - 300 acres of land on the Trent - NATHAN TISDALE was the executor. By 1816, JOHN COUNCIL BRYAN was called to court - HARDY owed a lot of people money - land was on NS Trent Note: in this file is an inventory for HARDY's estate taken in 1781 - 16 Negroes - by WILLIAM BRYAN - this appears to be in the wrong folder NOTE - from Sue - This is the son of John Council Bryan I and the father of John Council Bryan II 17. ISAAC BRYAN, ESQ 1795 - WILLIAM COX was exec and died CA 1802 - land on Trent River, Moseley Creek area - sale was 21 March 1794 - ISAAC had a will - HARDY was a legatee and received Negroes - this was the one with the mill to be sold - JOHN COX died leaving 2 sons, FREDERICK ISLER COX and SAMUEL COX, both minors - something to do with the BECTONS - ISAAC's land purchased from LEVI TREWLETT - 200 acres - some was allotted to JOHN COX'S heirs, some to FREDERICK A. or I, BECTON and another BECTON - can't read. 18. JAMES BRYAN - 1795 - CR 028.508.17.1 There are two file folders for James - about 4" thick. It took about 6 hours to wade through it and a more detailed look should be done at some time in the future. The actual information for the estate of James is at the end of the 2nd folder. 1. AN ABSTRACT OF THE PAPERS REGARDING A SUIT OF JONATHAN FELLOWS AGAINST JAMES BRYAN, GUARDIAN OF THOMAS KELLY. THIS APPEARS TO BE A DISPUTE REGARDING A PIECE OF LAND CALLED NOTTINGHAM POINT ON MAUL RUN ON SWIFT CREEK, CRAVEN COUNTY, NC. NOTHING IN THE FILES GIVES THE ACTUAL REASON FOR THE LAWSUIT OR WHY FELLOWS BROUGHT THE SUIT. THE SUIT WAS BEFORE THE COURT OF QUARTERLY PLEAS IN CRAVEN COUNTY IN 1802 AND APPEARS TO HAVE GONE ON FOR SOME TIME. AT THE TIME FELLOWS WAS MARRIED TO ELIZABETH BRYAN PUGH, WIDOW OF HUGH PUGH, JR AS PROVED IN PITT COUNTY DEEDS. MANY OF THE PIECES OF PAPER MAKE NO SENSE BY THEMSELVES AND CRAVEN COURT RECORDS SHOULD BE REVIEWED TO GET A CLEARER PICTURE OF THIS SUIT. a. Deposition of JOHN GOODING - JONATHAN FELLOWS is the petitioner and KELLY by his guardian, JAMES BRYAN, is the defendant. A note on the deposition states that this is not dated but believed to be about 1804. Forty years ago GOODING rented a piece of land on the NS Maul Run below Wilkinson's Point from JOSEPH CRISPEN who intermarried with the widow of WHEELRIGHT PEARSON. This same plantation afterwards was improved by THOMAS KELLY. CRISPIN rented land for the benefit of MRS. ANNIE OLIVER widow of _____OLIVER who was reputed to be lost at sea and her children JAMES and EUNICE - believe in the years 1786 and 1790 the despondent collection taxes ? in Craven and had conversations with THOMAS WHEELWRIGHT PEARSON and PEARSON said he had collected all the shares of the land. b. A division of land on the NS of the Neuse called Nottingham Point - 250 acres between JONATHAN FELLOWS and THOMAS KELLY by his guardian W. ? OLIVER - 1/5 to JONATHAN FELOWS and 4/5 to KELLY. c. Deposition of THOMAS OLIVER - knows Nottingham Point for 35 years. He knew ANN PEARSON the daughter of WHEELRIGHT PEARSON (this name crossed out and THOMAS PEARSON written in). She married JOSEPH OLIVER who was reported lost at sea. The widow lived on the land and later married PETER HYMAN. ANN PEARSON OLIVER had a son JAMES PEARSON OLIVER who went to sea 20 years ago and has not been heard from again. JAMES was about 16 when he went to sea. JOSEPH CRISPIN married the widow of WHEELRIGHT PEARSON who was the son of THOMAS PEARSON and had occupied the Point land. The despondent did not know him. CAPTAIN THOMAS KELLY settled on the land about 16 years ago and died there about 18/20 years ago. (SIC) THOMAS WHWEELRIGHT PEARSON purchased the shares of the daughters of his grandfather, THOMAS PEARSON - one was ESTER, the wife of JAMES LITTLE. Despondent said he heard THOMAS WHEELRIGHT PEARSON declared he had purchased all the shares in the Nottingham Point land except the shares of JAMES PEARSON OLIVER, the son of ANN OLIVER and he intended to purchase the shares of said JAMES as soon as he was 21. d. It appears that JAMES BRYAN was guardian of THOMAS KELLY in 1802. The petition of JONATHAN FELLOWS - THOMAS PEARSON of Craven died in the year 1748 having a will. WHEELRIGHT PEARSON, THOMAS PEARSON, JR. and MARY PEARSON were named as Executors. THOMAS desired his estate to be divided between THOMAS, JR., MARY, ELIZABETH, ANN, and ESTHER PEARSON. Part of this estate was a tract of land NS Neuce called Nottingham Point with 250 acres. ANN appears to be the widow and remarried JOSEPH OLIVER and had a son JAMES PEARSON OLIVER who survived his mother. ANN died instate, then JAMES the son died instate. ANN'S share descended to JAMES and it then went to EUNICE CONWAY (SIC) his only surviving sister of the whole blood who intermarried with Petitioner. EUNICE was entitled to the land which she sold to THOMAS HYMAN - her 1/5 part. From which your petitioner afterwards purchased the same. The other 4/5 of land came to be united partly by descendant and partly by purchase by THOMAS WHEELRIGHT PEARSON who devised the same to THOMAS KELLY an infant under the age of 21 and JAMES BRYAN was his guardian. The land was never divided. Petitioners to have 1/5 to be set apart for JONATHAN FELLOWS. On the same piece of paper June Term 1800 - JAMES BRYAN petitioned for THOMAS KELLY - (the original petition with the same information as above follows). Additional information - THOMAS PEARSON Jr. died soon after his father about 1750; immediately THOMAS WHEELRIGHT PEARSON, his nephew and heir, took the whole undivided track called Nottingham. He held this land until his death in 1791. It was thought he worked with the surviving legatees of THOMAS PEARSON - THOMAS WHEELRIGHT said the others did not have any right to the property - the land now was claimed by him long enough to be considered his. The court found in favor of JAMES BRYAN guardian to KELLY and FELLOWS appealed. e. JAMES BRYAN was dec by 1811 f. In a deposition of THO. OLIVER that a tract of land on Wilkinson's Point was owned by CAPTAIN OLIVER. There were also Negroes in the KELLY estate that JAMES BRYAN rented out. SUIT of JOHN OLIVER and wife and THOS. W. KELLY vs Administrator of JAMES BRYAN - JOHN SNEAD gave a deposition in the case that CAPTAIN KELLY was the father of petitioners THOMAS and ELIZABETH - this regarding the Negroes of the late CAPTAIN KELLY. One of the Negroes Abraham was considered a lawyer. NOTE: The information about the Negro, Abraham, being considered a lawyer was repeated several times and I re read it several times. This was highly unusual for the time period. (mmm) There were numerous bills in the files for expenses as well as for clothing etc. From the number of coats made for these children during the same years, they must have had half a dozen coats each. BETSY was boarded with PENELOPE FORBES during most of this time period. JAMES BRYAN was also the executor of the estate of EUNICE HALLING 1800/1801. JAMES BRYAN was Exec for the estate of THOMAS KELLY dec by1801. JAMES BRYAN was exec for the estate of MRS. ELIZABETH KELLY who was dec by 1798 There is a note from JOHN B. JASPER of Hyde County regarding the final settlement with FREDERICK BLOUNT, administator in right of his wife of the estate of JAMES BRYAN, dec. who was the executor of my father's, JAMES JASPER and my guardian - 5 March 1811 in the presence of Wm. SHEPARD. Another paper dated 22 August 1810 - JOHN B. JASPER of Hyde County - heir of ANN JASPER, late ANN HATCH, dec - received from FREDERICK BLOUNT and his wife RACHEL - 84 pounds 6 shillings and 8 pence in principal and 47 pounds 2 shillings and 3 pence in interest - being my full 1/12 part of the purchase money received by JAMES BRYAN for a tract of land containing 512 acres lying on ADAMS CREEK and conveyed to said JAMES BRYAN and WILLIAM BRYAN to NATHAN SMITH on 16 April 1801 - There is a note from MR. THOMAS LEWIS (FREEMAN) to JAMES BRYAN in 1802 ESTATE RECORDS FOR JAMES BRYAN NOTE: I have grouped theses records together for easier reading, but his actual records were throughout the file intermixed with records regarding his guardianship of KELLY and his executorship for other estates. a. RACHEL BRYAN was the executor in 1807. By 1808 she appears to have remarried FREDERICK BLOUNT. b. There was a bill for plotting land on Goose Creek for the estate of JAMES. This is important in trying to determine which line James came down. c. There is a list of Negroes hired out by the estate of JAMES in 1808 - there were about 25 Negroes with a list of names d. A petition to Court December Term 1817 - to divide Negroes held in common by RACHEL BLOUNT wife of FREDERICK BLOUNT, JOHN BRYAN, JAMES BRYAN, FREDERICK S. BLOUNT and ANN MARIE BLOUNT The Negroes are first to be divided into three parts between JOHN, JAMES, and ELIZABETH BRYAN to determine what was ELIZABETH's, who is now deceased (1811). Her part then to be divided into five parts - between WM. BLOUNT, ANN MARIE BLOUNT, FREDERICK S. BLOUNT, JOHN BRYAN and JAMES BRYAN. There were some thirty one Negroes divided first three ways then five ways. A list is given for the names of the Negroes. e. JOHN COBB was the guardian to JOHN and JAMES BRYAN and they sued their mother and her husband for partian of their father's estate - 1 September 1814. This paper states that JAMES died in 1806. f. Deposition of ELIZABETH WEST - JAMES BRYAN, son of JAMES BRYAN, dec. has since the death of his father resided for 18 months at one time with my late husband WILLIAM H. BRYAN and myself which no charge has been made or payment received. Also since the marriage of his mother to DOCTOR BLOUNT in October 1807 and before the death of Mr. W. H. BRYAN in August 1811, has been at our house free of expenses more than six months making a total of two years - deposition given on 1 November 1815. NOTE: In the Estate Records of Greene Co, a Thomas Person was dec by 1839 and there was further dealings with the Bryan family - John H., Laurence, Silas, a Mrs. Briant. I get the feeling there may be an intermarriage but can't sort it. 19. JESSE BRYAN 1794 - Miss SIDNEY BRYAN was a daughter - CARNIE JOHN BRYAN, JESSE BRYAN, sons, ELIZABETH BRYAN a daughter - all minors - WILLIAM BRYAN was guardian - JESSE had 500 acrs - SS Nuce and ES South River - JESSE BLOUNT BRYAN - house and lot - WILLIAM DAWSON BRYAN - Children were CLARISSA, JESSE, WILLIAM DAWSON, SIDNEY, JOHN CARNEY, ELIZABETH (BETSY) 20. JOHN C. BRYAN and RHODA LANE estate for the time being ignore this - by this time, it was a tossup which hurt the most, fingers, head, or eyes. I need to redo this and didn't even finish. Which it all started to run together and make no sense - it was time to stop. In 1820 - MARY ANN BRYAN sold Springfield - she appears to have been widow - JANE CARNEY and MARY BRYAN sued a couple of people together and sued each other for trepassing - JANE may have been the widow of JAMES CARNEY division to be made in 1825 of following lands - 85 acs on Maul's Run, 157 acs ??, 60 acs in Poplar Branch, 14 acs adj HAYE; 80 acs on the creek, 155 acs, 81 acs, 100 acs on Poplar Creek, 7 1/2 acs. Between JOSEPH BRYAN (who owns 1/4 part of said lands), WILLIAM BRYAN, ANN GRIMES, JOHN B. DAWSON Esq, ELIZABETH GIST, JOHN BRYAN and JENNETT DAWSON - own 1/8 part each heirs at law of JOHN BRYAN - his brothers and sisters - WILLIAM, LEWIS, EDWARD, ANN GRIMES, JENNETT DAWSON, SALLY BRYAN, MARY BRYAN, ELIZABETH GRIST and GEORGE BRYAN - 1/9 part each SALLY since died instate, EDWARD dec, sold his to LEWIS now dec with will and left to JOSEPH all his lands on SS SWIFT CREEK; MARY sold to JOHN B. BRYAN AND RHODA LANE: 1812 NOTE - from Sue - This really contains 2 estates: John Council Bryan of New Bern and Trent River, and John Bryan the son of Joseph (Swift Creek/Maul's Run Bryans). (I am not sure who Rhoda Lane is). For clarity, I've rearranged the items according to who they pertain to. Amt.:$1004.20 Date: 29 Apr 1809 ____________________ Petition for year1s allowance: Widow: Mary Bryan Date: June 1819 Commissioners: Can1t read. ______________________ Commissioners to make partition between: Mary Bryan Widow, Elizabeth B, Ann R B, Sally B, Alice B & Mary B., children and devisees, of John Councill Bryan. December 1807. _______________ Petition that lists heirs of William C or G Bryan: Thomas B (wife Betsey), John Justice and Mariah his wife, of Sally Bryan, of Alice Bryan & Mary Bryan, infants by Mary Ann Bryan, Council Bryan, infant by Nath Tisdale, William Tisdale, Betsey Tisdale, and Maria Tisdale infants by Nathan Tisdale. June 1809. ______________________ Commissioners appointed to make partition of a certain tract of land situated on Trent Road about two miles from the town of Newbern estimated to contain 100 acres between Rhoda Land and Thomas Bryan, Betsey Forbes, Maria Justice, Sally Alice & Mary Bryan and other heirs at law of John Council December 1809. There are several identical sheets to this in subsequent years­some list heirs, others just say Rhoda Lane and heirs of John C. Bryan. There is then one that states the devisees of John Council Bryan deceased and the heirs at law of Rhoda Lane, deceased. March 1813. There are many of these. _______________________________________________________ JOHN BRYAN OF SWIFT CREEK Division of lands: Tracts on Swifts Creek vis: one on Mauls run of 85 acres. one of 157 acres, one of 60 acres on Poplar branch, one of 14 acres adjoining Hayes, one of 80 acres on the creek, one of 165 acres and one on said branch of seven and a half acres between: Joseph Bryan (who owns 1/4 part of said lands) and William Bryan, Ann Grimes, John B Dawson Esq, Elisabeth Grist and John Bryan & Janet Dawson (who own 1/8 part each). November 1825. Same description lists the following heirs: Joseph Bryan (1/4) and William Bryan, Ann Grimes, John Grimes, John Dawson (1/8 each). May 1826. Another is same as 1st (exactly) dated December 1817. _________________ Petition by William B., John B. Dawson, Anne Grimes, Jennett Dawson, Elizabeth, John Bryan, and Joseph Bryan and infant of the said William B. Goes on to describe above property in detail, then says [above property] being purchased by the said John Bryan after the date and execution of his last will did pass under his will, but descended to the brothers and sisters of John Bryan. left the following brothers and sisters William B, Lewis B, Edward B, Anne Grimes, Jennet Dawson, Sally Bryan, Mary Bryan, Elizabeth Grist and George Bryan, who inherited each 1/9 part of said lands. Sally Bryan has since died intestate and without issue brothers and sisters at law. Edward B. by deed sold his part to Lewis Bryan who has since died, leaving a last will duly executed, whereby he devises to your petitioner Joseph Bryan all his lands on the South side of Swift Creek which includes his share of the lands described. Mary B. has conveyed her share to your petitioner, John B. Dawson. George Bryan has died leaving a last will whereby he devisees his interest to your petitioner John B. So that your petitioner Joseph Bryan devisee of Lewis B. now hold 1/4 part and [others] hold 1/8 request division, etc. No date. _______________________________________________________________________ JOHN C BRYAN: Estate - 1822 This really appears to be an estate record for Ann R. Bryan, daughter of John Council Bryan. Her guardian was Dorcas Rigor. Mary Ann Bryan was the widow of JCB. Thomas O Bryan is listed as Thomas O. Bryan on another slip in the folder, and there is a Thomas O. Bryan mentioned in the other JCB estate. ______________________ Inventory and account of sale of property of Ann R. NOTE: The names of the Lenoir Co Suttons and the Bryans are very similar. I wonder if there was an intermarriage. NOTE: Simon Herring, b. ca 1709, IOW, Va., son of John Herring and Catherine Morbe, married ca. 1735 to Ann ___?___. Proof that he was John's son has been established by a promissory note 1 Jan, 1753. He was granted 629 acres of land on east side of Bear Creek in Craven County 1 March, 1738 (later Johnston and Dobbs County) A Craven County deed of April 9, 1768 links him to wife Ann. Acquired land in Duplin, Sampson, and New Hanover counties as well as Craven and Dobbs. Appears on a 1769 Dobbs tax roll, so he was still living at that time. Headright records of 6 April 1745 show six whites and four blacks, but only one son has been proved --also named Simon Herring, who married his cousin, Rachel Herring about 1776.
