All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Connie Ardrey n/a May 2, 2019, 2:58 pm Source: North Carolina Archives Written: 1869 Will of Micajah Casey North Carolina Pamlico County In the Probate Court November 24th 1880 In the matter of the Probate of the Will of Micajah Casey dec'd Adjudication of Probate of Will A paper writing without subscribing witness purporting to be the last will and testament of Micajah Casey deceased is exhibited for probate before the undersigned Judge of Probate by Benjamin Casey, one of the executors therein named; and it is thereupon proved by the oath and examination of said Benjamin Casey that the said will was found among the valuable papers of the said Micajah Casey after his death; and it is further proved by the oath and examination of three competent and credible witnesses, to wit: Jno W. Dailey, Addison Peel, and Merit Wise and that they are acquainted with the handwriting of the said Micajah Casey, and verily believe that said will and every part thereof is in the handwriting of the said Micajah Casey. It is therefore considered and adjudged by the court that the said paper writing is the last will and testament of the said Micajah Casey and the same is ordered to be recorded and filed. J. H. Miller Probate Judge ------------- April nineteenth one thousand eight hundred sixty nine I Micajah Casey of the county of Craven and state of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last Will and Testament in manner and form following that is to say First that my executor shall provide for my body a decent burial suitable to the wishes of my relation and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as a part or parcel of my estate Item I give and devise to my beloved wife my household and kitchen furniture also my horse, cattle and hogs to have the same to live on and for the rest of the family to continue with her as they do now. I also give to my beloved wife my houses and all of the lands that I am in the possession of at my death to her to have the same her natural life or her widowhood I do then give to my four daughters, Zilpha, Susan, Nancy and Leveazer the houses and twenty acres of land taking the houses and ten acres lying east of the houses five acres in a slipe, also ten acres where the houses now __ I should live to clear the same I want them to have it and if not I want them to have it and clear it for themselves I also give my four daughters the privilege of getting fire wood and rail timber on the rest of my land to support the same to have and to hold their natural life or singlehood if either of my daughters do leave or marry or as many of them as may do so I leave the same to the rest of the said girls o have and to hold their natural life for a home and support thereby. Item I give and bequeath unto all of my sons Joshua, Elijah, Benjamin, Richd F, James B, Alexandria, Hardy and Lemon as they leave and have need of the same. I give to each of them one cow and calf, one feather bed and furniture. If the said cows and calves is on hand, also feather beds. If any or more of them fail to get cow and bed they shall have fifty dollars paid to them in the place thereof. I do leave my son William B out on the account of receiving his already. Elijah has received his bed. I give unto my four daughters one cow and calf each, each one feather bed each if on hand and if not fifty dollars to them be paid by my executor. I do leave my dear wife and my son Benjamin to be my lawful executors to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking declaring utter by void all other wills and testaments by me heretofore made. -------------------- Pamlico County In the Probate Court before Jas H Miller, Judge of Probate In the matter of the will of Micajah Casey dec'd - Benjamin Casey being sworn doth say: That Micajah Casey late of said county is dead having first made and published his last will and testament and that he and Sarah A. Casey ae he executors named therein. Sarah A. Casey the widow, J J Casey, Elijah Casey, Zilpha Casey, Benj Casey, Susan Spruill wife of Johnson Spruill, Nancy Casey, R F Casey, Jas B Casey, Hardy Casey, Lemon Casey and Shim Lewis and Thoddus Lewis Lewis children of Louisa Lewis (wife of Oliver Lewis crossed out) are the parties entitled under said will to the said property.
