This file was contributed for use in the USGenWeb Archives by: diane mason ==================================================================== In the name of God Amen I James Cuthrell of the state of NC and the County of Craven,planter being at this present writing prostrated on a bed of sickness with the prospect of death before me yet being of a sound mind and of a disproving memory do pronounce the following to be my Last Will and Testament; revoking all others of previous date. Item 1-- In case of death I bequeath my Soul to my Almighty Creator who gave it and recommend it to his infinite Mercy for my Saviors Sake. Item 2-- I give and bequeath to my dear brother David fifty acres of land lying on the Green Branch community known as the Paul land. Item 3-- I give and bequeath to my dear brother David One hundred acres of land, lying on Sofsen's Branch commonly known as the Joe West land. Item 4-- I give and bequeath to my dear brother, David a Tract of land containing about twenty three acres included in the David Cuthrell Patent. Item 5 -- I also give and bequeath to my dear brother David another Tract containing about one hundred and eighty acres beginning at the Beginning at a poplar and running with the patent line to the ?(run?) of the Shingle Swamp thence down the said run to the run of the main Creek and continuing the said course to the back line and from thence to the Beginning. Item 6-- I leave unto my dear aunt Solly (Sally?) Cuthrill the place on which I now reside, during her natural life with all the privileges as pertaining to the plantation and I desire that my dear brother David, pray keep the plantation in order. And at the death of my dear Aunt Sally Cuthrell I direct that the said plantation shall be sold, and the proceeds equally divided among my heirs. Item 7-- I also give and bequeath to my dear brother David fifty acres of land called the David Cuthrell patent lying on the marked beech branch. Item 8-- I give and bequeath to my dear brother Thomas Twenty five acres more on less out of the John Jones patent. Item 9-- I also give and bequeath to my dear brother David twenty five acres more or less out of a patent granted to David Cuthrell. Item 10-- I also give and bequeath to my dear brother David my Negro man Peter. Item 11-- I give and bequeath to my dear brother Thomas my Negro woman Chloe and child providing he shall pay the balance which still remains due for her. It is also my desire that as my brother David and self were doing business in partnership that the said business should be carried on to the close of the year and that my brother David should reap all the profits arising from said business. And at the end of the year I desire that all my perishable property shall be sold and the proceeds equally divided between my two brothers David and Thomas and my dear sister Polly It is to be clearly and distinctly understood that the money ? shall arise from the sole of my perishable property shall not be subject to any division until my proportional part of the Negro hire for the present Year 1836 shall be paid. It is to be further understood that I desire each and all of my just debts shall be paid, before any division shall take place from the sole of my perishable property.
