The submitter has given permission to the USGenWeb Archives to store the file permanently for free access.   Contributed for use in USGenWeb Archives by Gloria Taylor glot@netpath.net Sept. 2000  *********************************************************************** PETER HYMAN WILL 1780  In the name of God Amen this fourteenth Day of December in year of our Lord One Thousand Seven Hundred and Eighty I Peter HYMAN Planter of the County of Craven State of North Carolina being sick in Body, but of good and perfect Memory, thanks be to Almighty God and calling to remembrance the uncertain Estate of this transitory Life, and that all Flesh must yield unto Death when it shall Please God, to call do make, Constitute, ordain and declare this my last Will and Testament in manner and form following evoking and annulling by these presents all and every Testament and Testaments, Will and Wills heretofore by me made and declare by Word or Writing; and this is to be taken only for my last Will and Testament and none other. And first being penitent and sorry to the bottom of my heart for my sins, Past, most humbly desiring forgiveness for the same I give and commit my Soul unto Almighty God, my Savior and Redeemer in whom, and by the Merits of Jesus Christ, I trust and believe assuredly To be saved, and to have full Permission and Forgiveness of all my sins and that my Soul with my Body at the general Day of Resurrection shall rise again with Joy and through the Merits of Christıs Death and Passion (?), Possess (?) and inherit the Kingdom of Heaven prepared for his Elect and chosen and my Body to be buried in a Christian manner by my Executor hereafter named and now for the settling of my Temporal Estate and such goods and chattels as it hath pleased God to bestow upon me. I do order _________ not dispose the same in manner and form following: (that is to say) First, I Will that all those debts and Dues as I am in Right of Conscience to any manner of Person or Persons whatever shall be wills and truly contented and paid on ordered to be paid within convenient time after my decease, by my Executors.   Item, I give and bequeath all my Estate both real and Personal to my Son Thomas HYMEN to him and his Heirs Lawfully begotten of his Body forever.  Item, I give and bequeath the Plantation whereon I now live on to Hardy HUKINS for the space or time of Ten years from the date above provided the said Hardy HUKINS remains on the Plantation himself if Living, and at the expiration of said term or time, the said Hukins must deliver the said Plantation with its building thereon in good repair to my son Thomas HYMEN, Provided never theless my said Son Thomas HYMAN dies during his minority or without heirs then the above mentioned Plantation I give to the said Hardy HUKINS to him & his Heirs Lawfully begotten of his Body forever.  Item, it is my desire that all the moveable or Perishable part of my estate be sold except one bed and furniture, one oval Table, one dozen plates, three Basons, and three Dishes, one Chest one Gold Ring one Cow and Calf, two Cows and Lambs and one breeding Mare, the remainder or residue to be sold and the money laid out on the Educating of my said Son Thomas HYMAN as far as is necessary to the desecration of my Executors as I wish for him to be well educated and then bound to a trade.  Item, Provided my Son Thomas HYMEN and the aforementioned Hardy HUKINS both Dies without Heir or Heirs Lawfully begotten of their Bodies, then and in that case the Whole of my estate both real and Personal to be sold and the Money or the Value thereof to be laid out or invested in the education the Orphan Children of the Neighborhood wherein I now live as far as the Money will pay.  And Lastly I do hereby nominate constitute and appoint James BRINSON and Joshua FULSHIRE to be Executors to this my last Will and Testament. PEARSON Sidney CRISPIN Rachel (x her mark) HYMEN  State of North Carolina March Craven County Court 1781 The annexed last Will and Testament of Peter HYMAN deceased was duly Proved by the Oath of Thomas Wheelwright PEARSON one of the Subscribing Witnesses thereto who swore that he did See the Testator sign Seal Publish and Declare the same to be and contain his last Will and Testament, that at the time thereof the Testator was of Sound disposing mind and Memory. James BRINSON Executor therein Named Qualified as Such agreeable to Law.
