Contributed for use in USGenWeb Archives by Gloria Taylor glot@netpath.net Sept. 2000 *********************************************************************** GARRETT HYMMAN (WILL) 1765 C. 028.801.23 - 1768 File In the name of God Amen: I, Garrett Hinaman of the County of Craven in the Providence of North Carolina, Planter, calling to mind the Uncertainty of human life and knowing it is appointed for all Men one to die Being now of perfect mind and Memory Do make and ordain this my Last Will and Testament in manner following: Impremis: I recommend my Soul into the Hands of My Savior Jesus hoping through his merit Death and Suffering to have Remissions of my Sin a joyful Resurrection at the last Day and my body I desire may receive Christian Burial at the Discretion of my Executor hereafter named and touching the Estate I am now in possession with I give and Devise and Bequeath as follows: I give to my well beloved wife Rachel one black mare branded with_______, bed and furniture that I have also my will that she be allowed her thirds in both real and Personal Estate over and have what is herein particularly give to her and that she ___ without___ in an manner in the House I leave for her natural life. Item: I give and bequeath unto my daughter Mary FRANKLIN two Cows and Calves and in loan (?) My stock should decrease or fail then the value in money to be paid out of my personal Estate. Item: I Give unto my Daughter Hannah HUKKINS two Cows and Calves and in case my Stock should fail then the Value in money to be raised out of my personal Estate. Item: I Give unto my wife Rachel the use of large Iron Pot during her life and after her Decease I give the entire Property thereof to my Son Peter as I promised him I would do. Item: I Give and Devise unto my oldest Son Michael and his heirs forever 340 acres of land part of the Tract I live on to be laid off for him in like manner to Wit: Beginning at Middle Fence where the Mill formerly stood and so along the Fence as it now stands to the woods and then from the Place it stake (?) The woods West and by North at the ___ to the impersonal line it being the Southern part of the said tract of 640 acres. Item: I Give and Devise unto my Son Peter Hiaman and to his Heirs forever 300 acres of land the Residue of the tract herein before mentioned part where of I have before given to Michael to be laid off on the Northern Side of the said tract beginning at the Middle Fence and son on as near as may be as is herein aforementioned and my will is that if there should not be 640 acres in the that the Later shall have 300 acres to be laid off on the northern side as aforesaid forever and Michael the Residue on the Southern Side willing that Michael should have the largest part which said part distinctly I gave to each if Fee Simple. Item: I Give unto my said Peter and his heirs 100 acres of land on the Head of Durham's Creek where Nanny Barber lived to be laid off on the Western Side of all the land I hold there and all the Rest of my Land on the Head of Durham's Creek I Give unto my Grandson Garrett HINAMAN, Son of Michael to him and his Heirs and if he die under age without heirs, then I Give the same Lands to James HIAMAN oldest son of Michael and his Heirs. And whereas it is reported that my Son Garrett HIAMAN who went to Sea is dead and being not fully satisfaction with the ______ those of my Will and Desire is that he should have Grandson Garrett Western or be alive and the above Report prove false that then all the land which I hold on the Head of Durham's Creek where Nanny Barber lived herein just above given to my son Garrett in Fee Simple conditional be and remains unto my said son Garrett HIAMAN and his heirs forever and that the clauses above giving the said Land to Peter my Son, of Garrett Grandson be entirely revoked and void. But if my Son Garrett is dead now at the Date hereof that then the Desire to them in manner aforesaid made by good. And all the Rest of Estate not herein before particularly given away my Will and Desire is it be equally divided paying just debts being first paid between my Sons Michael Peter and Garrett (if my Son Garrett be now alive) and my Daughter Rachel to them and their heirs forever and if Garrett is dead that the Division be made among the three surviving Children. And Lastly I do hereby nominate and appoint my loving wife Rachel and my Sons Michael and Peter to be Executors of this my Last Will and Testament hereby revoking all former Wills by me heretofore made and declaring this to be my true Will and Testament in Witness whereof I have hereunto set my Hand and Seal this 24th day of June in the Year of One Thousand Seven and Sixty-five (or two, illegible).
