Fife their best friend, and Mary Wetherington minor by Elijah Hutchins his (sic) Guardian, humbly sheweth - That Stephen Wetherington late of Craven County died intestate in the year 1803, possessed of and entitled to a very valuable personal estate. That the said Stephen, left eight children viz your petitioner, Halley, Laney, Betsy & Mary Wetherington and John Wetherington, Nathan Wetherington, Ann the wife of Nathaniel Peters and Southey Wetherington, who were entitled to distribution of his personal estate of said intestate... but your petitioners charge that the said John, Ann & Nathan had been advanced by the intestate in his life time, nearly to the amount of their respective share of his personal estate. Your petitioners further show That administration of the estate of the said Stephen Wetherington was by this Court at Newbern 1803 granted to the said John Wetherington & Nathan Wetherington who possessed themselves by virtue of said grant of the goods, chatels & effects of the intestate to the amount of Two ? thousand pounds or some other large sum. Your petitioners have frequently in a friendly way applied to the said John Wetherington & Nathan Wetherington for a settlement of the amounts of their said administration & that your petitioners share of the personal estate of said intestate might be paid or delivered them for their use with which reasonable request the said administrators have hitherto refused to comply. To the end therefore that the said John & Nathan Wetherington may set forth & discover ?? & full inventory of the personal estate of the intestate of that the same consisted, how & when the same has been disposed of & the value thereof-that the said John & Nathan Wetherington & Nathaniel Peters & Ann his wife may produce to this court on oath an inventory or account of all the personal property given them or put into the possession of either of them by the said intestate in his lifetime, or be considered to have received each his full share of the said deceased estate and that the said John & Nathan Wetherington may be decied ?? to pay your petitioners their respective share of the estate of said Intestate & that your petitioners may have and other further relief in the premises as may be agreeable to equity & good conscience. May it please your Worships to grant your petitioners writs of subpona directed to the said John Wetherington and Nathan Wetherington and to the said Nathaniel Peters & Ann his wife & Southey Wetherington who don't join in this petition, commanding them to appear before you at the Court to be held at Craven County on the second Monday in ???, then & there to answer the premises & to perform & abide such decree as to your Worships shall meet.
