BREECE - (03 Mar 1793 - 11 Aug 1858) In the name of God, Amen: I, FREDERICK D BREECE of the County of Cumberland, State of North Carolina, do make publish & declare this to be my last Will and testament. First, I desire my Executor, hereinafter to be named, to pay my just debts & funeral expenses. I give and bequeath to my wife SARAH my plantation on the East side of Cape Fear River, known as my home place, with all & singular the improvments, etc to have use & occupy during her natural life: and after her death to my son, JOHN, to him & his heirs forever. I give & bequeath to my wife SARAH during her natural life, my three slaves: Dolly, Joanna & Priscilla and after the death of my said wife my will & desire is that Dolly shall go to my son JOHN, his executors & administrators: Joanna to JAMES, his executors & administrators and Priscilla to REBECCA, my daughter & her personal representatives. I give & bequeath to my wife SARAH, absolutely, all of my hogs, stock cattle, farming utensils of every & all kinds whatsoever, household & Kitchen furniture at home place (with the exception of four beds & bedsteads hereafter to be disposed of) together with the corn, fodder & supplies that may be upon home place at my death. I give and bequeath to my son JAMES & his heirs, executors and administrators in trust for the sold & separate use of my daughter NANCY, the wife of THADDEUS BOND, my house & lot in the village of Sunbetow (sp?), County of Robeson, it being the same lot as by deed from W. W. Gunn to me registered in Registers office, Robeson County will fully appear & after the death of my said daughter for the use benefit and behoof of her children their heirs and afsigns forever. I also give & bequeath to my son JAMES, his executors & adminsitrators ten share of Stock standing in my name upon the books of the Bank of Cape Fear: in trust, to pay over to my said daughter Nancy the wife of Thaddeus Bond, the dividends thereon to be declared during her natural life: and after her death to hold the same for the use & benefit of her children. I give & bequeath to my grandson FREDERICK BOND, son of THADDEUS & NANCY BOND, Two Hundred Dollars to be expended upon his education under the control & direction of my Executor hereinafter to be named. I do hereby relinquish and release to THADDEUS BOND all claim or claims that I may have against him for monies paid or advanced upon notes at Bank as indorsed for him or otherwise directing my Executor hereinafter to be named to cancel the same in full discharge. I give and bequeath to my son JOSEPH BREECE, his Executors and Adminstrators, ten shares of Stock, standing in my name upon the Books of the Bank of Cape Fear: in trust to pay over the dividends thereon to be declared, during her natural life, to my daughter ELIZA JANE, wife of JOHN JONES: and after her death to hold the same for the use & benefit of her children. I give & bequeath to my grandson, FREDERICK JONES, son of JOHN and ELIZA JONES the sum of Two Hundred Dollars to be expended upon his education, under the control & direction of my son JOSEPH BREECE. I give & bequeath to my Grand daughter MARY, daughter of JOHN & ELIZA JONES, my negro girl Betsey. I give devise & bequeath to my son JOSEPH BREECE & his heirs in trust for the use benefit & behoof of my Grandson FREDERICK, son of JOSEPH & ELIZABETH BREECE & his heirs, all of that tract or parcel of land on the East Side of Cape Fear River, known as the Eccles place, joining the lands of George Laurence and others. I give and bequeath of SARAH ELIZABETH, my granddaughter, daughter of JOSEPH & ELIZABETH BREECE, my negro girl Martha, to her, her executors and administrators. I give & bequeath to my grand daughter GONABY, daughter of JOSEPH & ELIZABETH BREECE, Five Shares of Stock, standing in my name upon the Books of the Bank of Cape Fear, to her, her executors and administrators. I do hereby relinquish & release to my son JOSEPH BREECE all claim or claims that I may have against him for monies paid or advanced upon notes at Bank or elsewhere as indorsed for him or otherwise: directing my Executor hereinafter to be named to cancel the same in full discharge. I give devise & bequeath to my son JAMES BREECE, & his heirs and afsigns forever, all of that tract or lot of land in the Town of Fayetteville in the North side of Per (appears to be Person) _____ & Bow Street - with all & singular the Store house & improvements thereon: the same being the Store house & lot as by deed from John Mullins to me, registered in Registers office, Cumberland will more fully appear. I give & bequeath to my son JAMES BREECE his executors and administrators all of the goods wares & merchandise of every and all kind ____ in Store on Person Street together with the book accounts, notes & evidences of debt for goods sold: charging him to pay off, satisfy & discharge any and all debts justly due & owing by the said store at the time of my death. I give and bequeath to my daughter REBECCA her executors & administrators the five following slaves to wit: Lavinia & her children, Ben, Gus and two other children of the said Lavinia, now in being, not named. I give devise & bequeath to my daughter REBECCA and her heirs and afsigns forever all of that lot or parcel of land on Dick Street in the Town of Fayetteville, beginning on Dick Street at the corner of Haigh's lot, & running South on Dick Street to a line, parralel with Haigh's east line so as to include one and one quarter acres and no more. I give and bequeath to my daughter COLUMBIA, her executors & administrators my three negro slaves to wit: Tom, Beckey & Bill. I also give and bequeath to my said daughter COLUMBIA Five Hundred Dollars in money, to be paid by my executor. I give and bequeath to my son LUTHER, his heirs and afsigns forever, all of that tract or parcel of land lying and being on Dick Street in the Town of Fayetteville, with all & singualr the improvements thereon (save & excepting the one & one quarter acre herein before devised to my daughter REBECCA) it being the tract of land as by deed from A. A. T Smith, late Cl'k & Master, to me registered in Registers office, Cumberland, will more fully appear. I give and bequeath to my son LUTHER his executors and administrators my negro boy Charles. I devise my Executor hereinafter to be named, to pay to my son LUTHER the sum of Eight Hundred Dollars upon his arriving at the age of twenty one: on such balance of the sum of Eight Hundred Dollars as may not have been expended by my executor for the education of my said son LUTHER. I give & bequeath to my son JOHN, his executors and administrators my negro slave Sam. I give and bequeath to my daughter SARAH, her executors and adminsitrators, the five following salves to wit: Hannah, & her children, Cornelia, Susan, Rhody & Mary Jane. I give and bequeath to my daughters COLUMBIA & REBECCA & my sons JOHN & LUTHER each a bed & bedstead. I charge my Executor hereinafter to be named to see that my father JOSEPH BREECE is well cared for & decently supported so long as he shall live & properly interred at his death. I give and bequeath to my wife during her natural life, Nine Shares of Stock standing my my name upon the Books of the Fayetteville & Northern Plank Road Company, and after her death the same to go to my son in law JOHN V JONES his executors and administrators. I give and bequeath to my son JOHN, Five Shares of Stock standing in my name upon the Books of the Bank of Cape Fear to him his executors and adminsitrators. The remainder of my property & estate whatever it may be after satisfying my debts, the devises bequests & legacies herein, I bequeath to my son JAMES, his heirs executors & administrators. I do nominate constitute and appoint my son JAMES BREECE ___ true & lawful Executor to carry and perform the true intent of this my last Will and Testament. In testimony whereof, I, FREDERICK D BREECE have herunto set my hand and affixed my seal this 19th day of March A.D. 1858. Breece, deceased is exhibited for probate in open Court by JAMES BREECE, the Executor therein named and the due execution therof by the said Frederick D Breece is proved by the oath and examination of Philamon Taylor & J W Lett the subscribing witnefses thereto. It is therefore considered by the Court that the said paper writing and every part thereof is the last Will and Testament of the said Frederick D. Breece, & the same is ordered to be recorded and filed. And thereupon the said James Breece, Executor as aforesaid, duly qualifies as such by taking the oath prescribed by Law. J. T. Warden, Clerk.
