Austin Sr. of the County of Currituck and State of North Carolina being weak of Body but of Sound disposing mind and memory bless be the Almighty God for it falling to mind the non certainty of this life and it being ordained for all people to die, I do make and ordain this Instrument of writing to Contain my last will and Testament disannulling all other wills and Testament heretofore Made by me, either by word or writing and this only to be Taken as my last will and Testament, first, that is to Say I recommend My Soul to almightly God, that first gave it and my body to be buried decently in a Christian like manner in a place where it Shall please my Executor hereafters named.----And as to what worldly estate it hath been pleased God to bestow me, for above my disorts I give and dispose of In manner and form, as followth, first my will and desire Is that all my just debts, and funeral Charges Should be paid in convenient time, after my decease, Item--my will & desire is that My loving wife Mary Should have the use and Service of my three Negroes, during her natural life, and after her decease give unto my beloved Son Daniel my Negro boy Martin to him And his heirs. Item--I give unto my beloved daughter Peggy, after My beloved wife Mary's decease, my two other Negroes Jimmy & Wallace, to her and her heirs lawfully begotten of her body. Item--I give unto my beloved wife Mary all the moveable Estate that was her own property when we came together that is remaining at her disposal at her decease, Item--I also give unto my loving wife Mary all the rest of my moveable estate that is remaining to use, Sell and fully enjoy for her Support during Her natural life, and then what is remaining to be equally divided between my loving Son, Daniel and my Daughter Peggy. Item--I give unto my Son Thomas one Shilling. Item--I give unto the heirs of my Son Cornelius one Shilling. Item--I give unto the heirs of my Son Will one Shilling. I also constitute & appoint my loving wife Mary, and my friend Hezekiah Farrow, My whole and Sole executor, to this my last will & Testament to Settle all my business according to this my last will and Testament And the law, Shall require as witness my hand and Seal this 21st Day of January 1804.
