Etheridge, William S. - 1838 - Currituck County, NC - Wills Submitted for use in the USGenWeb Archives by Jean Schroeder Currituck County Book of Wills #4, page 50 - 52 The Last Will and Testament of William S. Etheridge deceased exhibited at August Term 1838 and duly proved by the oath of Joshua Harrison Jurat and ordered Recorded. In the name of God Amen, I William S. Etheridge of the County of Currituck and State of North Carolina being weak in bodily health and of sound disposing mind and memory and knowing the certainty of death and the uncertainty of life thereof do make and ordain this my last and Testament by first of all recommending my soul into the hands of all mighty God who give it and my body to be decently buried at the discretion of my executor and as to the worldly substance which it has pleased God to bestow on me I give and dispose of in manner and form as follows: Item 1 I Give to my daughter Mary Guard one Negro woman named Patience Also one mare now in her possession and one Hundred dollars in cash to her and her heirs forever. Item 2 I Give to my two Grand Daughters Sabra Hackit and Mary Hackit the sum of Two Hundred dollars Between them and should either die with out lawful heirs her part is to go to the surviving one and should both die with out lawful heir the whole is to go to my daughter Mary Gard and her heirs for ever - - - Item 3 I Give to my daughter Sarah Gard one Negro woman named Sinthey and one Negro girl named Eliza and one Hundred acres of Land Knowen by the name of Daniels Land to her and her heirs for ever Item 4 I Give to my daughter Abie Dough one Negro woman Priscila which (she has sold and received the money) to her and her Heirs for ever. Item 5 I Give to my on Tart Etheridge one Negro woman named Matilda and child named Roberd to him and his heirs Item 6 I Give to my son Spence Etheridge one half of my schooner Flag of Truce which is now in his possession and which he has A Bill of Sale for him and his heirs for ever Item 7 I Give to my daughter Faney Etheridge the one Negro woman named Rachel and Two Hundred Dollars in money to her and her heirs. Item 8 I Give to my son William Etheridge the houses and Land whereon I now live being fifty acres which I Got by my first wife and it is my desire that all my children by my first wife execute a deed to him as soon as he arrives at the age of Twenty one for their part or parts of said land and if they do not, Each one failing it is my will that one Hundred dollars be deducted from their part which is left them and that goes to William if any. I Also give to my son William one hundred acres of Land lying to the Eastward of my house binding the land I bought of Isaac Tillett and the Fresh Pond and running far enough Southerly to include one hundred acres to him and his heirs for ever. Item 9 I Give unto my son William the one half the schooner Flag of Truce which he has a bill of sale for to him and his heirs for ever. Item 10 I Give to my son Thomas B. Etheridge Five Hundred dollars in money one Negro man named Manuel and should said Negro Manuel die before my son Thomas then for him to have the best Negro man belonging in my Estate to wait on him and attend him during his life - Item 11 I Give to my daughter Harriett B. Etheridge Two Hundred and fifty acres of Land north of my House which I bought of Isaac Tillett with the privilege of the beach to the east of the Fresh pond. Also one Negro woman named Milly and increase from this date and four Hundred Dollars in money and bed and bedsted and furniture which runs on rolers to her and her heirs for ever. Item 12 I Give to my son Tart Etheridge and my son William Etheridge and my daughter Harriet B. Etheridge the residue of the Tract land adjoining the Land of Thomas R. Tillett decd (a part of which I have all ready given my son William) to be held by them in common or divided as they may think proper it being Known by the name of the Heirs Tract to them and their Heirs for ever. Item 13 All my land Knowen by the rise Ground Beach I Give to all my children to be held between them all as a privilege forever Item 14 I lend to my son Spence Etheridge during his natural life the Tract of land where he lives with the Houses & belonging there to and after his death to be sold and the proceeds divided between all my children namely Tart Sally Mary Abie William and Fanny Etheridge Item 15 All my Negroes not given away I wish to be sold for a credit of six months and out of the proceeds thereof I wish my daughters Polly, Sally and Abie to have each one Hundred dollars and the Balances equally divided between my Sons Tart, Spence, William and Thomas B. Etheridge. Item 16 I Give to my daughters Mary and Sally fifty acres of Land lying S W Side of Collinton to them and their heirs forever Item 17 All the residue of property which I have not otherwise disposed of I wish to be sold for a credit of six months and the proceeds to be divided among all my children equally. Lastly I nominate and appoint my son Tart Etheridge my whole and sole executor to this my last will and Testament ratifying and confirming this and no other. In witness whereof I have here unto set my hand and seal this the 28 day of May in the year of our Lord 1836 in presence of, Joshua Harrison William S Etheridge Wm J Chaplain I William S Etheridge of Currituck County do make this codical to be taken as part of my last will and Testament as follows Viz whereas in my will above I have omited to give to my daughter Harriett B. Etheridge one Negro boy a child of Negro woman Milly which I have Given to said daughter Harriett I now therefore give to said daughter Harriett the said Negro boy named John to her and her heirs forever over and above what I have here in witness my hand and the day above written Signed Sealed and declared in the presence of Joshua Harrison Jurat Wm J Chaplain William S.
