N.C This Indenture, made the Thirteenth day of November in the year of our lord one hundred and Twenty Seven between James Ellis of Davidson in the state of North Carolina of the one part and Henry Ellis of the county of Davidson and state of North Carolina of the other part, Witnesseth, that the said James Ellis for and in consideration of the sum of Four Thousand One hundred and Fifty Dollars to him in hand paid by the said Henry Ellis the receipt wherof the said James Ellis doth herby acknowledge…hath given , granted, bargained and sold, aliened and confirmed and by these presents doth give, grant, bargain and sell, alien and confirm unto the said Henry Ellis his heirs and assigns forever, all that tract, piece or parcel of land situate, lying and being in the county of Davidson and the State aforesaid on the waters of Swearing Creek. Beginning at a hickory the old beginning corner of said Tract thence East seven chains to a burch on the west bank of Swearing Creek, thence North Six chains and thirty two links to a hickory David Smiths corner . Thence East sixty eight chains & Twenty links to a persimmon in place of white oak the original corner. Thence West fifty eight chains & forty links to a stake Elizabeth Kelleys corner. Thence North seventy five links to a hickory on Mrs Kelleys corner. Thence North thirty one chains and fifty links to the beginning containing by estimation Four Hundred and Sixty Three Acres more or less purchased by Anderson Ellis from the heirs at law of Wilson Macay Decd. And conveyed by the said Anderson Ellis to me. And also, all woods, ways, water and water courses, and all and every the appurtenances thereunto belonging, or in any wise appertaining, and the reversions , remainder and remainders, rents, issues and profits of the aforesaid lands and premises, and every part thereof, and all the estate, right, title, interest, claims, property and demand whatsoever of the said James Ellis of, in and to the land premises hereby granted; to have and to hold the aforesaid lands and premises, with the appurtenances, unto the said Henry Ellis his heirs and assigns, to the proper use and behoof of the said Henry Ellis his heirs and assigns, forever; And the said James Ellis for him and his heirs the aforesaid land and premises, and ever part therof, against himself and his heirs, and against the claim or claims of all and every other person or pearsons whatsoever, to the said Henry Ellis his heirs ans assighns, shall and will forever warrant and defend gy these presents.
