Daniels Davidson County I Nelson J. Daniels, of the County of Davidson and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in the following manner and form. Viz: First, that my executor (herein after named) shall provide for my body a decent burial suitable to the wished of my friends, and pay its expenses together with all my just debts out of the money and personal property that I may have on hand at my death. Second, I give and devise to my youngest son, John Daniels all the home tract of land on which I now reside, beginning at the branch of on John Daniels line and running up said branch and with the same to J. W. Holland's line which is all west of said branch, supposed to contain about twenty five acres, during his natural life, then to his children during their natural lives, then to his grand children, and if no bodily heirs, then to his brother and sisters their natural lives, and then to their grand children. Third, I give and devise to my son, Milton Daniels all that tract of land lying East of the above named branch adjoining the lands of A. E. Daniels and J. W. Holland, supposed to contain about twenty acres, during his natural life and at his death to his children during their natural lives, and at their death to his grand children, and at their death to his great grand children. Fourth, my will and desire is that my son, John Daniels, pay Theodosia Daniels two hundred and fifty dollars for her share in money. Fifth, my will and desire is that my son, Milton, pay one hundred and fifty dollars to Victoria Shore, wife of David Sore, in order to make a fair amount to her, I having made some advancements to her heretofore. Seventh, after my just debts are paid or if my sons, John and, Milton, an my daughtes, Victoria, an Robeca and Theodosia Daniels, will pay all my just debts, I give the personal property to them to be equally divided between them. All the lands and property hereby bequeathed will remain under the control of my wife, Charity Daniels, during her natural life, and for her support and maintenance. Eight, I appoint my son Milton Daniels, my executor to all intents and purposes in order that this, my last will and testament, may be carried out, March the 22 1884. State of North Carolina In the Superior Court Davidson County A paper purporting to be the last will and Testament of Nelson G. Daniels deceased, is exhibited before me, the undersigned, Clerk of Superior court for said County, by Milton Daniel by the oath and examination of Edward Sink & Alex. E. Daniel, the subscribing witnesses thereto: who, being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the last will and Testament of Nelson G. Daniels. That the said Nelson G. Daniel in the presence of this deponent subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 22d day of March 1884. And the deponent further saith, that the said Nelson G. Daniel, the testator aforesaid, did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him, and exhibited , to be his last will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said Will as aforesaid, and at the time of the deponents subscribing his name as an attesting witness thereto as aforesaid, the said Nelson G. Daniel was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents say not.
