Judy Wright email Kwright354@aol.com I David Curry of the County of Davidson and State of North Carolina being of sound mind and memory, but considering the uncertainty of life, do make and declare this my last Will and Testament in manner and form following, that is to say, First, That my Executor hereinafter mentioned shall provide for my body a decent burial suitable to the wishes of my relations friends and pay all funeral expenses together with all my just debts however and whomsoever oweing out of the moneys that may come into his hands as part or parcel of my estate. (2) I will and bequeath to my beloved wife Sarah Curry during her natural life, the use and control of my home tract of land in order that she may make a support therefrom, also one horse her choice, theree head of cattle, her choice, six head of sheep her choice, all the hogs on hand thirty bushels of wheat, fifty bushels of corn, fifty dollars in money to be paid to her by my Executor and such household and Kitchen furniture as she may desire to keep. Also one plow harness for one horse, and two large waggon loads hay. Second I will and bequeath to my son Smith Curry the tract of land upon which he now lives, on conditions that he pays to my son Shepherd Curry the sum of forty dollars in money, also he shall pay to my son David D. Curry the sum of forty dollars in money. 3rd I will and bequeath to my son Shepherd Curry, my home tract of land including a sufficient quantity of the tract upon which my son David Curry now lives to make the home tract contain one hundred forty acres (beginning at the NE corner of home tract) which he is to hold subject to the bequest made to my wife Sarah Curry, also one Bureau, one bed furniture, one plow gears, one horse , waggon. Fourthly. I will and bequeath to my son David D. Curry the tract of land upon which he now lives with the exception of the piece I leave willed to go to the home tract, which shall be taken off as follows. Beginning at the North east corner of the home tract at Post Oak, thence North for enough to make the quantity by running west the whole length of the tract. Fifth. I will and bequeath to my daughter Esther Curry one colt or fifteen dollars in money , one small wash pot, one loom and harness which my wife Sarah Curry shall have the use of during her natural life, also I will and bequeath to my daughter Esther Curry the sum of fifty dollars in money which shall be paid to her by my executor also one milk cow and one bed and furniture. Sixth, I will and bequeath to my five daughters to wit, Anna, Elizabeth, Lavina, Esther, and Sarah Curry all my beds & furniture which shall be divided amongst them after the death of my wife Sarah Curry, or at any time she may think proper to give them into their possession. Seventh. I will and devise that all the balance of my property be sold and equally divided between my sons and daughters. And lastly I do hereby constitute and appoint my worthy son Shepherd Curry my lawful Executor for all intents and purposes to execute this my last will and Testament, according to the true intent and meaning of the law, and my post and close thereof hereby revoking and declaring entirely void all other wills, testaments by me heretofore made. Phillip ALLEN Whereas I David Curry of the County Davidson and State of North Carolina have made my last Will and Testament in writing bearing date the 7th day of September A.D. 1850, and have hereby made sundry devises and bequests according to the then existing circumstances of my estate in connection with my health and the health of my wife, but the health of myself and wife both having changed and we are both advanced in age, and consequently our bodily infirmities have increased, and as our beloved son Shepherd Curry, has been a faithful and dutiful son to us, in our old age and during our infirmities in providingfor our comforts, I do by this writing which I hereby declare to be a Codicil to my said will to be taken and construed as a part thereof, I will and direct that my son Shepherd Curry shall have forty acres of land in addition to what I have heretofore willed him, to be taken from the tract on which my son Smith Curry now lives, to be measured to him from the west end of said tract. I also give to my son Shepherd Curry the horse and waggon which I have willed to my wife, after her death. I also give to my son Shepherd my two horse waggon and harness. In testamony whereof I hereunto set my hand and seal, this the 4th day of June A. D. 1855 David (his mark x) Curry Signed , sealed, published and declared by the said David Curry to be a Codicil or part of his last will and testament in the presence of us what his request and in his presence and the presence of each other do subscribe our names as witnesses thereto. Henderson ADAMS E. ADAMS Soloman B. LOSE or LORD ?? I David Curry of the County of Davidson having made and published a last will and Testament on the 7th day of Sept. 1850 and also having made a Codecil to the same on the 4th day of June 1855 and having thereby made sundry devises and bequests, according to the then existing circumstances of my estate and family, but the circumstances of my daughter Esther having changed from which they were at the time, she then being a single woman and I expecting her to remain with my wife so long as we both should live for that consideration I devised and bequeathed to her the said Esther Curry the sum of Fifty dollars to be paid to her out of my estae, but she having since married and left us, I now revoke and annul said clause which I gave her the fifty dollars, and I do hereby declare this codicil to be a part of my last will and testament. In testimony whereof I hereunto set my hand and seal, this the 27th day of June 1856 David (his mark x) Curry Signed, sealed, published and declared by the said David Curry to be a Codicil or a part of his last will and testament in the presence of us who at his request do subscribe our names as witnesses. ADAMS p. 198 next will is that of Joel DAVIS I Joel Davis of Davidson County N.c. do hereby give and devise unto Julina CLINE the house in which she formaly lived situate on my land together with two acres of land immediately around said house with the priviledge of use of water and all the other priviledges connected therewith which she is promised by me to enjoy during my life, to have and hold the same during her life, but should my heirs, at any time after my death, conclude to sell the tract of land on which said house is situate, they may also at the same time sell said house and two acres of land, and in that case they shall immediately on making the sale forwith and convey by good title unto the said Juliana CLINE … continues on p. 199. p. 194 Will ending before that of David Curry is that of Phillip WALSER, witnessed by Henry WALSER and John MYERS.
