N.C To my cousin Robert Ellis as trustee for my Cousin Mariah McDonald, wife of Thales McDonald, all my tract of land lying in Rowan County containing 564 acres which I purchased of Kilpatrick, with all the negroes on said plantation to wit. Old Esther, Little Ben , Alfred, Betsey, Franklin, Het (Easter’s daughter) , Caroline, & Lydia ( children of Easter) George Up-ham (Easter’s son and his wife Emma and her child Sarah) Old Hampton, Easter, Hampton’s wife & their 3 children, to wit: Ned, Osbourn, & Nancy, Henry & Sam Hampton’s children David Isom’s son, Brutus & Nell, also all the stock, farming tools, all crops now growing ( except the cotton ), all provisions with all the household, the future increases of everything on said plantation to be managed by Robert Ellis, Trustee. The net proceeds are to be paid to Mariah McDonald annually as long as she may live and at her death to be divided among her then living children. I leave in the hands of my executor the sum of $300.00 to be applied to the repairing of our family burying ground on the plantation whereon my aunt Judith Ellis now lives. He is to procure a decent set of marble tombstones for my father, mother & brother Henry for my grave. Should it not take all to execute the work above named, the balance is to be kept at interest & the interest applied to the repairs of the said graveyard as it may need it. To the trustees of the Jersey Settlement Meeting House the sum of $200.00 to help complete the new Church now in building. To Mary Ellis, who is I suppose is my wife-in law- the sum of $5000.00 which is to be full of all the part which she & her child now at her breast are to have. To John A. Bradshaw, son of Austin Bradshaw, my gold lever watch. I will that Alexander, Jane, Amanda, children of Molatto Eliza, bought of John A. Chaffin by my brother Henry, deceased, & by his bequeath to me remain in my estate & that my executor to have full power to convey them to a free state in order to set them at liberty so that they, Alexander, & Jane Amanda may have their full freedom & when they arrive in a free state that the expenses of conveyance & $100.00 to each one of them be paid out of my estate. I will that my executor ell my negro woman Eliza, willed to me by my brother Henry, deceased, also my tract of land lying below Bradshaw’s Mill, adjoining the lands of David Smith & the lands of John L. Hargrove, deceased, together with all my personal property of ever description, negro slaves excepted, on all my plantation in Davidson Co. on a credit of 12 months & after paying all my just depts. & the bequest in this will, the residue of said sale, together with all my cash which may be on hand & notes & accounts be divided equally between the following persons: My cozens Robert Ellis, son of John Ellis, deceased, John W. Ellis, Sarah Ann Elli, Mary Jane Ellis, & William Anderson Ellis children of Anderson, deceased. I also give to the said Robert Ellis, John W. Ellis, Sarah Ann Ellis, Mary Jane Ellis & William Anderson Ellis all my lands in Davidson County, lying continuously on Swearing Creek, Potts Creek, known as the Jersey Lands. Also my Negroes in the County of Davidson now living on said lands are to be divided equally. I empower my executor to sell the interest which I have in the store of Holmes & Ellis at the Washington Mine at per cost privately on a credit of 6 months, and the proceeds of which to go into my estate & to be divided as above directed, also the interest in the notes & accounts or cash to be divided in the same way.
