Austin, Judge of Probate In the matter of the Administration of the Estate of Anderson Hendrix John Hendrix & Richmond Hendrix being sworn doth say that Anderson Hendrix, late of said County, is dead, without leaving any Will or Testament; and that Conrad Hendrix is the proper person entitled to Letters of Administration on the estate of the said Anderson Hendrix. Further, that the value of said estate, so far as can be ascertained at the date of this application, is about $500.00 and that John Hendrix, Richmond Hendrix, Conrad Hendrix, Zadock Hendrix, Elizabeth Thornton, William Hendrix's heirs (J.M. Hendrix), Nancy Dwiggins, Henry Hendrix, Daniel Hendrix, Jehue Hendrix, Ningey Hendrix, Anderson Hendrix, Cynthia Cornatzer & Chivin Sprys children are entitled as heirs and distributees thereof. John Hendrix Richmon Hendrix Sworn to and subscribed before me, this 9th day of January, 1872 H.R. Austin, Probate Judge --------------- To the clerk of the Superior Court of Davie The petition of Conrad Hendricks as administrator of Anderson Hendricks, respecfully showeth that Anderson Hendricks died intestate in Davie County a short time since and that on the 9th day of January A.D. 1872, letters of administration were granted to your petitioner on the Estate of said Anderson Hendricks. That said Anderson Hendricks was possessed of a small personal Estate consisting of some hogs, household & kitchen furniture, a horse, some cattle & other property that in the present pecuniary condition of the Country, with the homestead and exception existing - it would be injudicious and unsafe to sell the said property on a credit & your petitioner sheweth that the interests of the Estate would be promoted by a sale for cash instead of on credit & would therefore ask the clerk to make that order. as your petitioner will ever [word unclear] C. Austin probate judge --------------- North Carolina Superior Court Davie County Conrad Hendrix & others against John Hendrix & Richmond Hendrix petition for Partition Repost in and enrolled This cause coming on to be heard upon the repost of Samuel Foster, Coleman Foster and John Taylor commissioners appointed by an order of this Court, and on the reading and filing of the repost, which bears date April 22nd 1874, by which it appears that said Commissioners have made partition of the lands described in the pleadings in accordance with the agreement made between the parties to the above named suit, in pursuance of a decree of this Court into Thirteen (13) parts between the parties according to their respective rights and interests in said lands, and have set off to each the allotment specified in the repost. The parties having been served with due Notice and no exceptions having been filed thereto. It is now an motion of J.M. Clement, counsel for petitioners ordered and adjudged that the repost be in all respects confirmed, and that the share of Ningey Hendrix have judgment against the share of James M. Hendrix for $33.09 - and against the share of Cynthia Cornazter for $10.09 - and against the share of Conrad Hendrix for the sum of $20.64 [second numeral isn't clear, may not be zero] And the share of John & Richmond Hendrix have judgment against the share of Conrad Hendrix for the sum of $57.62 And the share of Anderson Hendrix have judgment against the share of Conrad Hendrix $3.58, and against the share of Elizabeth Thornton for the sum of $21.93, & against the share of Jehue Hendrix heirs for the sum of $3.31 and the share of Chivin Spry's children have judgment against the heirs of Jehue Hendrix for the sum of $48.87 and against the share of Nancy Dwiggins for the sum of $33.58 and against the share of Henry Hendrix' heirs for the sum of $8.08 and against the share of Zadock Hendrix for the sum of $4.x8 [ink spot obscures this digit] And that Daniel Hendrix have judgment against the share of James M. Hendrix for $33.09, and against the share of Cynthia Cornatzer for $10.09 and against the share of Conrad Hendrix for $20.64 Said sums having been charged by the commissioners in the repost against the more valuable dividends in favor of the dividends of inferior value in order to make the division equal - and it is further ordered and adjudged that each of the parties to wit: N. Hendrix, Daniel Hendrix, H.E. Robertson Guar. of Jehue Hendrix' heirs, Cynthia Cornatzer, Elizabeth Thornton, Anderson Hendrix, Conrad Hendrix, John & Ricd Hendrix (as one share), Nancy Dwiggins, D.S. Tucker Guardian of Chivins Spry's children, P.R. Martin Guar. Henry Hendrix heirs, James M. Hendrix and Zadock Hendrix pay one thirteenth (13) part of the cost of this action and that execution issue thereon. H.B. Howard, C.S.C October 2nd, 1874 approved this 14th Oct 1874 Tho. J.
