Davie County Register of Deeds Deed Book 10, pg 283-284 1855 Hiram Phelps to John Wesley Shutt This Indenture, made the first day of November in the Year of our Lord One Thousand Eight Hundred and Fifty Five between Hiram Phelps of the County of Davie, and State of North carolina, of one part, and J.W. Shutt of the County of Davie, and State of North carolina of the other part: Witnesseth, That the said Hiram Phelps for and in consideration of the sum of Two Hundred and Twelve Dollars to him in hand paid by the said J. W. Shutt the receipt whereof the said Hiram Phelps do th hereby acknowledge, hath Given, Granted, Bargained and sold, Aliened and Confirmed, and by those Presents do Give Grant, Bargain and Sell, Alien and Confirm unto the said J. W. Shutt, his Heirs and Assigns forever, all that tract , Piece, or Parcel of LAND, situate, lying and being in the county of Davie Bounded as follows viz Beginning at a stone on the east Side of the Fulton Road thence South 40 chains to a pile of Stone thence East 31 chains to a Black oak thence North 40 chains to a Black gum thence West 31 chains to the Beginning containing one hundred and twenty four acres More or less And also, all the Woods, Ways, Waters and Water-Courses, and all and every the Appurtenances thereto belonging, or in any wise appertaining, and the Reversion and Reversions, Remainder and Remainders, Rents, Issues and Profits of the aforesaid LANDS and PREMISES, and every part thereof, and all the Estate, Right, Title, Interest, Claim, Property and Demand, whatsoever, and the said Hiram Phelps of, in, and to, the Lands and Premises hereby granted.....To have and to hold the aforesaid Lands and Premises, with the Appurtenances, unto the said J. W. Shutt to the proper use and behoof of the said J. W. Shutt his Heirs and Assigns, to the his Heirs and Assigns, forever: And the said Hiram Phelps doth warrant and defend the title of said land for himself and his Heirs, the aforesaid Land and Premises, and every part thereof, against all and his Heirs, and the claim or claims of all and every other person or persons whatsoever, to the said J. W. Shutt his Heirs and Assigns shall and will forever WARRANT and DEFEND, by the Presents. IN WITNESS WHEREOF, the said Hiram Phelps hath hereunto set his hand and affixed his seal This the day and year first above written SIGNED, SEALED, AND DELIVEREDIN THE PRESENCE OF S. Orrell Hiram Phelps seal North Carolina, Davie County H. H. Howard personally appeared before me and after being duly sworn says that he knows the handwriting of Hiram Phelps maker of the deed hereunto attached, having often seen him write, and that his signature to said deed is in his proper handwriting and that the said S. Orrell, subscribing witness of Phelps maker are dead or are nonresidents of this state. Therefore, let the said intrument, with this certificate, be registered. This 21st day of Dec 1885 A. T.
