State of North Carolina Davie County, January 24th in the year of our Lord 
Eighteen Hundred and Forty Eight I JAMES McAFFEE, being of sound mind though 
weak in body do make and declare this to be my last Will and Testament in the 
manner and form here in after described. First – I give my body to the dust 
from whence it came, it is my desire to be decently buried and I do hereby 
nominate and appoint JOHN McRORIE to act as Executor of my Estate – my with 
and desire first that all my just debts should be paid as soon as convenient 
after full payment of all my debts, I give the residue of my Estate in the 
manner herein specified – I give and bequeath Bay mare to POLLY McGUIRE to 
have during her life and after her death I give the said mare to JAMES 
McGUIRE – I wish and divide my plantation where JOHNSTON  is now being sold on 
a credit and the proceeds as of said land given to JAMES McGUIRE – My pistol I 
give to my friend RICHARD DUFFEY, also my ----? known as the Declans, the 
other -----? I give to JAMES McGUIRE, also give him my Gun – It is my 
particular wish that my old Stallion should be well treated, I give him to my 
friend EDWARD PARKER – My Stallion Cut---?, my wagon and gears, my books and 
all the other property not heretofore named I wish -----?, and the proceeds 
after paying my debts, I wish equally divided for the use and benefit of my 
friends SALLY and POLLY McGUIRE, during their lives, and after their death I 
give the balance remaining to JAMES McGUIRE (this latter gift in checks my 
Book accounts ---? as Notes, and all species of Debt that may be due me, I now 
declare this to be my last Will and Testament making null and void all other 
therefore made by me, if any such should be found ----? whereof I have 
hereunto set my hand and seal the day and date before ----?

Additional Comments:
The above James McAffee/McAfee was brother to Dr. Samuel McAffee/McAfee - and 
uncle to Dr. James McGuire.  According to hand written notes left at the Davie 
County Public Library by Jane McGuire (granddaughter of Dr. James McGuire)
Sarah "Sallie" McGuire and Samuel McAfee were parents to Dr. James McGuire.  
Samuel McAffee was witness to the 1826 Will of James McGuire, Sr. (Dr. 
McGuire's grandfather).  According to Jane McGuire's notes James McAffee lived 
with Dr. McGuire's uncle, Thomas McGuire, until his death in 1848 in Davie 
County, NC.
