All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Glinda Edmonds GDVEdmonds@aol.com October 10, 2007, 11:45 am Source: Original Copy Of Polly Mcguire's Will Written: July 3, 1853 I, Polly McGuire, of the County of Davie and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last will and Testament, in manner and form following that is to say: First - That my Executor (here in after named) shall provide for my body a decent burial, suitable to the wishes of my relations and friends, and pay all funeral expenses together with my just debts, however and to whomever owing as here in after directed. Item - I give and devise unto my niece, Polly Turner, twenty-five acres of land to be laid off by the commissioners appointed by the court so as to include my dwelling house and spring and a proportion of woodland, to her and her heirs and offsprings forever. Item - I give and devise unto my nephew, James McGuire, twenty acres of land, to be laid off by the commissioners as said, as to include the field adjoining his mother’s land as may best suit his wishes, but having proper regard as to the balance of the tract, to him and his heirs and offsprings forever. Item - I give and devise unto my nephew, James McGuire, as trustee, all the balance of my tract of land, to have and to hold the . . . to him, his heirs and offspings, in Trust for the use and benefit of Timothy McGuire, for and during the term of his natural life, to enable him to raise his family and after his death, to his children, including those here after born, and their representatives, their heirs and offsprings forever, the said land to be under the entire control of the said James McGuire as Trustee, for the purpose of said, and not be subject to the control of the said Timothy McGuire, nor his debts. Item - I give and bequeath to my niece, Polly Tuner, my three hogs, my provisions on land and all my grain, including that growing. Item - I give and bequeath my sister, Sally McGuire, and my niece, Polly Turner, all my household and kitchen furniture, including my wearing apparel to be equally divided between them, and if they cannot agree upon a division, the commissioners appointed to divide the land, to divide the same. Item - I give and bequeath to William McGuire, son of Timothy McGuire, my milk cow. Item - I give and bequeath unto my nephew, James McGuire, all my money on hand and all notes and debts -- me of every description, out of which he is to pay my funeral expenses and all my past debts. And lastly - I do hereby constitute and appoint my nephew, James McGuire, my lawful Executor, to all intents and purposes to execute this my last will and Testament, according to the --- in truth and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other wills and Testaments by me hereto fore made. Harbin, Clerk Additional Comments: NOTE: Polly McGuire was the daughter of James McGuire and Eleanor Luckey. Polly never married. The James McGuire that is referred to in her will is Dr. James McGuire, son of Polly’s sister, Sarah “Sally” McGuire. According to a family file left at the Mocksville Library by Jane Eccles McGuire (granddaughter of Dr. James McGuire), Dr. James McGuire was the son of Sarah “Sally” McGuire and Dr. Samuel McAfee of Davie County, NC. Dr. Samuel McAfee was from Ireland. He died on August 18, 1847 in Davie County, NC.
