Smith, Clerk of Superior Court, New Bern, to Sheriff of Dobbs County [Abraham Shepard] to sell the property of Stephen Cade, former sheriff of Dobbs County, for a particular amount, May 11 State Records Collection Colonial Governor's Papers Record Group Arthur Dobbs (2 Apr 1689-28 May 1765) Papers Call Number C.G.P.5 MARS ID 308.7.1.70.1 North Carolina {Seal} George the Third by the Grace of God, of Great-Britain, France, and Ireland King Defender of the Faith &c To Abraham Shepard Esq'r late Sheriff of the County of Dobbs - Greeting whereas on a writ of Venditione Exponas issued on a Judgement recovered by His Excellency Arthur Dobbs Esq'r Governor &c against Stephen Cade Esq'r late Sheriff of Dobbs County for the sum of one thousand five hundred and fifty pounds ten shillings proc for Debt also one pound two shillings and sixpence the money in and by our said Court to Him adjudged and taxed for his costs and charges in that behalf expended returnable to our Superior Court in May 1761 you the then Sheriff returned the said writ Executed and taken goods &c lands and tenements not sold for want of time and on motion of the Plts attorney it was ordered by our said Court that a Pluries Venditione Esponas issue whereby &c we command you to sale pursuant to Law the several things by you levied on heretofore and not sold for want of bidders and the money arising thereby to return before our Cheif Justice and his aforesaid Justice at the next Superior Court of Justice to be held for the District of Newbern at the Court House in Newbern the second day of November next then there to render into our said Court the debt and costs aforesaid besides your fees for this service herein fail not and have you then this Writ - Witness Charles Berry Esq'r Cheif Justice of our said Province at Newbern the 11th day of May in the 4th year of our Reign Anno Dom 1764 AmbCox Bagby CL C N.B. AmbCox Bagby CL C The schedule to which the hereunto annexed referes by virtue of the within writ to one directed I have proceeded to make sale of the lands and effects within mentioned as to one is command viz. Two hundred acres of land on the west side of Walnut Creek and one water grist mill to Robert Jones Junr. Six feather beds and furniture for eight eight pounds eight shillings and six pence besides costs and my own fees And two parcells of land lying on the east side of the said creek one Negro man slave named Buck and forty head of black cattle taken on the writ of Fieri Fracias appearing by the register of the County of Dobbs to be mortgaged to the said Robert Jones Junr are delivered up to him and the residence of the effect to him on the aforesaid writ still remains in my hands for want of buyers - Abr.
