Dobbs County, NC - Court Records File contributed for use in USGenWeb Archives by Grace Williamson Turner Transcribed and posted by Lori Price Cobb (jhcobb@iquest.net) The Confession of Joseph Killet Taken on Tryal Thos Harrison, Jno Cato, Robb'd Wm Radford of Courency, Hard Money & a coat one pair of Breeches, one Hunting Shirt & Linning Shirt, and further that sd Harrison ________ Stole a Sorrel Mare of Hampton Syllavan, and sd Harrison, sd Cato, Andr Killet Junr, David Lawhon Robbed Peter Lee of one Mare, one Saddle, one Green Cloak, one Gun & some Money; and that he believes sd Lawhon Sold sd Mare to Jno Honeycut upon the Waters of Deep River; and that sd Harrison, sd Kato Stole Jno Edwards's Horse, Mare, he sd Joseph Killet saw the above Men on sd Horses, and that they sold sd Horses either to Jas Farr, Capn Joeson or Jno Arthur, between Jones's Creek, Tompsons Creek's & sd Harrison Stole Jno Roache's Horse, and he heard him say he would Shoot the Horse as soon as he Rode him to Neuse River _______ and that on Tuesday 27 of this Instant he saw sd Lawhon with two Mares which he said he Borrow'd the White one of Robt Key & the Dark Bay of David Rainer _______ and that on Thursday 28th of Instant he sd Joseph Killet, sd Lawhon went to Mr Winkfields where sd Lawhon & himself Stole a Gray Horse which he was to let one Jno Cole have to carry up towards Salisbury to Sell for Halves ________ The Said Killet Further say that he Hired one Jno Vick to take his place as a Soldier and returned him to Lieutenant McNeas under the name of Jno Mitchel, and also says as he and sd Vick was going to Kingston they called at James Miles's when he saw Vick Steal a pair of Leather Breeches out of Miles's House _______ _________ Furthermore the sd Joseph Killet on his Examination saith that the following Persons doth Harbour and assist both Thieves and Deserters Viz Saml Stricklen, Thos Daughtry, Andrew Killet Senr, William Killet Junr in Dobbs County, Robt Key, Kinchin Citchen, Isaac Wheeler, Jno Miles, David Miles, Wm McClam, Joel Joiner, Benjn Joiner, Geoe Cato, Jno Barefoot, Peter Lee & Selah Thornton in Duplin County____________ The Confession of Joseph Killet taken before me this 30th day of July 1779 his Andrew Bass Joseph X Killet Mark Ansor of the Testimony against Joseph Killet for Horse Stealing. Jos. Windfield - Prosr 28 July lost a horse of a gray colour of pounds 600 curr. money. Dr Bass bro ? the horse to him next morning. Jas. Daniel ---- Saw Killett on the horse two hours before day, 12 miles from Winkfields. There had been thieves in the neighbourhood, uspecting him to be one ordered him to stop for riding far before, but did imediately after, & presented his gun-Shot at him- His horse threw him at the fire, & he was apprehended. Whose hores? His Bror And. Killett's - the horse run away - the next morning he and Roach followed the track of the horse- And others went different ways- the others found Mr W's horse with the bridle on - saddle fell when he did, there being no girth - it had been apprehended, & carried to Bass's - He denied at first it was the same horse, but afterwards owne it - gave several different accounts. Asa Pipkin & David Cogdel much to the same respose with Daniel-Gelding-Dobbs. The Deposition of David Rainer This Deponant says that on the Night of the 27th of this Instant he the sd Rainer had Feloniously Stolen from him one Small Bay Mare Sworn Before me this his 30 Day of July 1779 David X Rainer Andrew Bass mark The Deposition of Joseph Winkfield This Deponant says that on the Night of the 28 day of the Instant he the said Joseph Winkfield had on Gray Mare Feloniously Stolen out of his Pen Sworn before me this his 30 Day of July 1779 Joseph X Winkfield Andrew Bass mark The Deposition of Michael King, James McDonal, Asha Pipkin, Jesse Pipkin, Joshua Carroway, Bryan McCullin, David Cogdell and John Roach These Deponants say that on the Night of the 28th of this Instant, they saw Joseph Killet and one other Man unknow to them who had in their Possession the above Proved Horse and a Mare, & one other Gray Mare, that the above Deponants took the said Joseph Killet & that the other Person made his Escape Sworn to Before me This 30 Day of July 1779 Andrew Bass State of North Carolina Newburn District Know all men by these present that William Killet, James McDaniel of the County of Dobbs and Jesse Ward of the County of Duplin and all of the province aforesd are held and firmly bound unto this state in the pennil sum of ten thousand pounds Current money of this state assigned with our hands and seals and Dated this 21th Day of October 1779 _____ The Condition of the above oblagation is such that if the above Bounden William Killit shall Well and truly make his persinal appearence at the Court of Oyr and terminer held at Newburn the 15th of November Next and there to answer a Charge of petit larseny and Not to Depart the sd Court Without leave of the sd Court then this oblagation to be void and of None Effect other Wise to Stand and Remain in full force and Virtue in law ______ William Killet seal Signed sealed and Delivered James Daniel seal in the presents of us Jesse Ward seal Saml Oates William King __________________________________________________________________________ USGENWEB NOTICE: In keeping with our policy of providing free information on the Internet, data may be used by non-commercial entities, as long as this message remains on all copied material.
