Records, 1702-1779, S.S. 312 North Carolina George the Third by the Grace of God of Great Britain France and Ireland King Defender of the Faith &c To the Sheriff of Dobbs County Greeting, Whereas Abraham Sheppard junr hath Complained on Oath to William Speight Senr one of the Justices of the Inferior Court of the County of Dobbs, that William McTyer late of your County planter is justly indebted to him in the Sum of Twenty pounds Proclamation money and Oath having been also made That the said William McTyer hath removed himself priviatly out of your Said County or so Absconds or Conceals himself that the Ordinary processors of Law Cannot be Served on him and Hath Given Bond and Security according to the Direction of the Act of Assembly in Such Case made and provided We Therefore Command you That you Attach the Estate of the said William McTyer if to be found in your Bailiwick, or so much thereof repleaveable on Security as Shall be of Value Sufficient to Satisfy the Said Debt & Costs and such Estate so Attached in your hands To Secure or so to provide That the Same may be Liable to Farther proceedings thereupon to be had at our next Inferior Court to be held for the County of Dobbs at the Court House in Dobbs on the Second Tuesday in October next so as to Complete the Said William McTyer to Appear and answer the above Complaint of the Said Abraham Sheppard junr when and where you Shall make known to our Said Court how you shall have Executed this Writ Witness William Speight Senr one of our Said Justices of our County of Dobbs at Dobbs County aforesaid the 22nd Day of August in the 7th year of our Reign William Speight Sr Whereupon, the Sheriff of Dobbs County in Obideance to the above Writ to him Directed, made the following Return To October Court 1767 (To wit, That he had Levied the said Attachment in the hands of Jesse Samford Adm'r of Lazrus Chelton Dec'd John Garland and Richard Barfield & Summoned them to appear at the Said Court &c Signed by John Drew Deputy Sheriff James Glasgow Attorney North Carolina George the Third by the Grace of God of Great Britain France & Ireland King Defender of the Faith &c To the Sheriff of Dobbs County Greeting We Command you That of the Goods & Chattles Lands & Tennements of Richard Barfield late of Dobbs County Planter by you attached in a Suit brought by Abraham Sheppard junr ag't Said Richard Barfield as guarnishee of William McTyer you Cause to be Exposed to Sale & the monies thereby arriving you Safely keep so that you have them before the Justices of our Inferior Court of Pleas & Quarter Sessions to be held for the County of Dobbs at the Court House in Dobbs on the first Tuesday in July next then & there to render and Satisfy unto Abram Sheppard Junr his Said Damages and Costs &c Therein fail not and have you then & there this Writ Witness Martin Caswell Clerk of our Said Court at his office the III'd Day of April in the VIIII'th year of our Reign Anno Dom 1769 Martin Caswell Clk Glasgow Attorney 1767 Abraham Sheppard ag't William McTyer Clerks fees (to wit) For the Attachment returned executed 14/ ------------------------ 0.14.0 Default & Inquiry ag't Defendant 10/ ------------------------------ 10 Judgment against Gaurnishedness of Continuance to January 4/------- 12 Continuance to April 4/Judgment final against Gaurnished 8/ ------- 12 Continuance to July 4/the Same to October 4/ ----------------------- 8 October Venire Tryal call fees thereon 10/ -------------------------------- 10 Making up record 6/ Execution 5/ ---------------------------------- 11 _______ 3=17=0 County Tax 2/6 Attorneys fee J.
