Between Samuel HERRING of Dobbs County and province of North Carolina, a Planter of the one part and Richard HINES of the county and province aforesaid of the other part. Witnesseth that for and in consideration of the sum of Ten pounds proclamation money in hand well and Truly Paid the Receipt whereof I do humbly acknowledge and own and thereof and every part and parcel thereof, Doth Hereby acquit Exonerate and forever discharge the said Richard HINES his heirs Executors administrators and assigns and every of them By these presents and I the said Samuel HERRING sell unto the said Richard HINES his heirs Executors administrators and assigns Containing by Estimation, One Hundred acres of land Butted and Bounded as Follows: Beginning at a Poplar, Samuel HERRING’S corner tree then Running north, Samuel HERRING’S line 300 poles to a Black Jack. Samuel HERRING’S corner thence north his line to aspire in Samuel HERRING’S line then north a straight line to a pine in Patent containing Four Hundred acres - granted to Samuel HERRING, Bearing date the 13th day of July 1773. To have and to Hold the said Bargained premises with all the appurtenances privileges and Comm—— to the same Belonging or in anywise appertaining to him the said Richard HINES, his heirs and assigns forever to this and there only proper use benefit and Behoof forever and I the said Samuel HERRING for me and my heirs Executors & administrators do Covenant and Grant to and with the said Richard HINES his heirs and assigns that before the unsealing hereof. I am the true sale and benefit, Owner of the above Bargained premises and am lawfully seized and ———— at the same in mine? own proper Right, as a God’s? perfect and absolute Estate of inheritance in Fee Simple and have in myself good Right, full power and lawful authority to grant Bargain sell and confirm the said Bargained premises in manner as above said and that the said Richard HINES heirs and assigns shall and may from time to time and at all times forever here after By power and virtue of these presents lawfully and peaceably and quietly Have Hold use Occupy possess and enjoy the said Devised and Bargained premises with the appurtenances free and Clear and freely and Clearly acquitted Exonerated and discharged of and from in and all manner all former and other Gifts grants Bargains Sales leases and gages Wills entails Jointures, dowers judgements executions encumbrances and extents his the more? I the said Samuel HERRING do Covenant and engage the above devised and Bargained premises to him the said Richard HINES, his heirs and assigns against the lawful Claim or Demands of me my heirs Executors or Administrators or any other person or persons whatsoever laying any Right Title or Claim to the above Bargained premises or any part or parcel thereof.
