An Act to Vest in Trustees Certain Powers for the Benefit of Elizabeth Torrens and Her Children. Whereas the court of pleas and quarter sessions for Dobbs county hath been pleased to grant for the benefit of Elizabeth Torrens and her children, a certain portion of real and personal estate of Thomas Torrens, suggested to have been confiscated, and the order of the said court not having been sufficiently explicit in declaration of the use or appointing the trust; to prevent inconveniency and confusion that may therefrom arise: I. Be it Enacted by the General Assembly of the State of North Carolina, and it is hereby Enacted by the authority of the same, That James Kenan, John Molton and James Sampson, be and they are hereby appointed trustees for the purposes of laying off one third part of the personal estate granted as aforesaid, for the sole benefit of Elizabeth Torrens, the remainder to be for the sole benefit of her children. And the said Elizabeth having relinquished her right in the lands granted as aforesaid to her children, II. Be it further Enacted, That the said trustees shall have power and authority so to use the same as to them may seem most fitting to promote their improvements for the benefit of the said children; or if it should appear to them conducive to the advantage of their trust, to sell the said lands for the purchase of others of greater or equal worth to the said children. II. And be it further Enacted by the authority aforesaid, That the trustees aforesaid or a majority of them, before entering on the execution of their trust, shall take the following oath, viz. "I, A. B. having been appointed by the General Assembly a trustee for the purpose of managing the estate real and personal granted by the court of pleas and quarter sessions of Dobbs county, for the use of Elizabeth Torrens and her children, do swear that I will truly, faithfully and impartially manage the same, agreeably to the powers in me vested, according to the best of my knowledge and ability. So help me God." IV. And be it further Enacted by the authority aforesaid, That the said trustees before entering into the execution of the said trust, shall enter into a joint and several bond to the chairman of Duplin court, in the sum of five thousand pounds for the use of Elizabeth Torrens and her children, to be void on condition of the equitable discharge of their said trust, and shall make return of all their proceedings to the said court of Duplin; which is hereby declared to have such superintending powers in the premises over the proceedings of the said trustees as they exercise in cases of orphans and guardians.
