Mason http://www.genrecords.net/emailregistry/vols/00022.html#0005225 February 23, 2022, 4:50 pm Written: 1826 Transcribed by Sloan Mason slomas7@comcast.net Register of Deeds Duplin County, NC Bk.2 p, 45-47 Dickson SLOAN & wife Katherine of Sampson Co. to Peter CARLTON of Duplin Co., NC-46 acres 16 January 1826 This Indenture made the Sixteenth day of January in the year of Our Lord One thousand eight Hundred & Twenty six between Dickson SLOAN & his wife Katherine SLOAN of the State of North Carolina & County of Sampson of the one part & Peter CARLTON of the same State & County of Duplin of the either part. Witnesseth that the said Dickson & Katherine SLOAN for & in consideration of the sum of Seventy dollars to them in hand paid the receipt whereof is hereby acknowledged hath given granted bargained sold conveyed & confirmed by these presents do give grant & bargain sell alien & convey the said Peter CARLTON his heirs, Exr.’s & Adm.’s. & assigns forever a certain tract or parcel of land, situate lying & being in the County of Duplin & on the head branches of Rockfish Creek, Beginning on a Stake on the run of lightwood bog branch & running with Bright WATSON’S line N 2 E 73 poles to a pine, thence with Ormond JAMES line N 88 W 72 poles to a red oak, thence with said JAMES’S line S 2 W 43 poles to a pine then N 88 W about 45 poles to a Stake thence S 2 W 4 poles to a Black Gum on lightwood log branch a little below JAMES’S ford, thence down with said run as it meanders to the beginning containing by estimation Forty Six acres of land be the same more or less, excepting nevertheless I reserve to myself the full privilege of Twelve acres of Land around the House wherein John SELLARS now lives for the term of four years from the date hereof. To have & to hold the aforesaid bargained land & premises together, except (except the part as above excepted, with all & singular the privileges, advantages, & impertinences thereunto longing or in any wise appertaining unto him the said Peter CARLTON his heirs, Exr.’s, Admr.’s, & assigns shall & will warrant & forever defend against us Dickson SLOAN & Katherine SLOAN our heirs, ex’s., admr’s. or assigns as also from & agains the lawful claim or claims of all & every other person or persons whatsoever. Whereas Peter CARLTON hath produced a Deed of Conveyance made to him from Dickson SLOAN of a certain tract or parcel of land lying & being in the County of Duplin in the State of North Carolina & procured the same to be Registered by Peter CARLTON in the Court of Pleas & Quarter Sessions of our County of Duplin & it being represented to our said Court that Katherine SLOAN, wife of the said Dickson SLOAN is so infirm that she cannot travel to the aid Court of our said County of Duplin to be privily examined as to her free consent in executing the said conveyance & therefore we command you or any two of you that at such certain day & place as you shall think fit, you go to the said Katherine SLOAN, if she cannon conveniently come to you & privily & apart from her husband, examine her the said Katherine SLOAN whether she executed the said convey — freely & of her own accord without fear or compulsion of the land Dickson SLOAN her husband; & the examination being distinctly & plainly wrote on the said Deed or on some paper annexed then & when you shall have so taken the said examination, you are to send the same closed up, and on the Seals of you or any two of you, together with this writ: unto our said Court to be held for the said County of Duplin on the 4th day of August next ensuing, in the year of our Lord 1828. Witness: James PEARSALL, Clerk of our said Court at Office the 4th Monday of May A.D. 1828. & in the 52 year of the Independence of said State. Jas. PEARSALL, Clk. Being appointed by the County Court of Duplin to take the private examination of of Katherine SLOAN relative to her assigning the within Deed to Peter CARLTON, who says she done it freely & voluntarily without fear or compulsion of her Husband.
