Q, p. 387-388 James MATTEWS of Sampson Co. & Andrew THALLY of Duplin Co, NC, executors of the late David SLOAN of Duplin Co. to Mark MIZELL of Duplin Co., NC. 15 March 1807 Andrew THALLY & James MATTHIS, Exr’s to Mark MIZELL Deed 150 Acres Land This Indenture made this fifteenth day of March in the year of Our Lord One thousand Eight hundred & seven - Between James MATTHEWS of the County of Sampson & Andrew THALLY of the County of Duplin (both in the State of North Carolina) of the one part; Executors to the Last Will and Testament of David SLOAN, late of Duplin County, Dec’d and Mark MIZELL of the County of Duplin & State of North Carolina on the other part. Now this Indenture Witnesseth that the Said David SLOAN in his life time, & in the year of Our Lord One thousand seven hundred & ninety nine (1799) & on the Eighth day of February gave a bond of One hundred pounds Penalty, to Mark MIZELL, binding himself his heirs, Executors & to make or cause to be made and Executed a good & sufficient Deed of Conveyance for a certain piece or parcel of land, Butted & bounded as follows (Towit) lying & being in Duplin County on the South side of Maxwell Swamp & on both sides of Buck Branch it being part of a Tract of 640 Granted to the Said David SLOAN by Patent. Beginning at a Pine and lightwood Stump on the N side of Buck branch thence S 70 E 54 poles to a Pine, thence S 50 E 186 poles to a Lightwood Stump, then S 40 E with SHEFFIELDS line 34 poles, thence William FILMIT’S? line S 50 W 127 poles, to a Stake, thence a Straight line to the beginning, containing by estimation One hundred & fifty acres be the same more or less. Now this Indenture witnesseth, that we the said James MATTHEWS & Andrew THALLY for & in consideration of the Sum of Fifty pounds Good & lawful money to us paid for the use of the heirs of the said David SLOAN, Dec’d the receipt whereof is hereby acknowledged - Have by these presents, Bargained, Sold, Conveyed & Confirmed and by these presents do absolutely, Grant, Bargain, Sell, Coney & Confirm unto the said Mark MIZELL his heirs & assigns forever, the aforesaid Land & premises with the appurtenances thereunto benign and we the said James MATTHEWS & Andrew THALLY, Executors as aforesaid, for & in Consideration of the sum of Fifty pounds in hand & in consequence of lifting the Bond of One hundred pounds, do for ourselves, our heirs, Exr’s. & Admrs. Warrant & defend the aforesaid Land & premises to him the said Mark MIZELL, his heirs & Assigns forever, as also & against the just & lawful claim of all & every other person or persons so far as we as Executors to the said Will are Enabled Empowered.
