Duplin County, NC - Thomas DeVane Settlement, 1794 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Delamar Extracts, Pages 1-200 Legislative Papers Relating to Revolutionary Service NC Archives Thomas Devane of New Hanover County, Petition respectfully sheweth that in the month of June 1778 he commanded a company of nine-months men, and continued in said service for fourteen months, that he sent his papers to Warrinton in order to have them there settled, but the person intrusted with that business failed to get a settlement. Your petitioner further represents that he exhibited his accounts to the Commissioners at Hillsborough, who refused to settle the same, and at the last session represented his case to the General Assembly, who deferred a determination on his Memorial to the present Session. In this situation your petitioner again solicits your Hon'ble body to grant him the pay, which his faith in the State let him to expect at the time he performed said service. He therefore trusts & hopes that although he has long been delayed in payment, & been put to a great deal of trouble yet an allowance will not be made and finally compensate him for the same. Jas. PEARL, Capt. in the Continental Line, makes oath in Cumberland Co. on 6 Nov. 1792, that Thos. Devane was a Levy Officer Rank of Captain and joined the rendesvous with the Levy Soldiers for nine months march to the southward returned and collected such as was not then able to march which and other services compleated or nearly the term of nine months. Theophilus WILLIAMS of Duplin County, makes oath that he new that Thomas Devane of New Hanover County was chose a Captain of the nine months men and was commissioned as such by the Governor of the State, said commission bearing date 1 June 1778. Further deponent sayeth that about the fourth of June 1778 that said Devane joined at the place of randevoze at which place he staid with his Company tell about the sixth of Sep'tr 1778 at which time Collo Armstrong came and furlow the men for six months. Being all on about the first of Nov'r in 1778 he the said Devane met at head Quarters with his Company and marched them to the aid of South Carolina under the command of General Ash Till Yirling on the fruntears of South Carolina was taken and Commanded by General Lycon and was marched to Parisburg, and this said Capt. Devane commanded his Company till about the furst day of March at which time he the said Devane was sent after deserters to the State of North Carolina. This may certify that I was in Company with Daniel Williams on the last of July or the first of August in the year seventeen hundred & seventy nine in search of Continental deserters what sd Williams called upon Capt. Thos. Devane as an officer to assist him that sd Devane did turn out and assist him. Fre'ck Barfield, J.P. Nov. 28, 1792-Duplin Co. Morris FENNELL of Duplin County makes oath, December 23, 1793, that on the first day of June 1778 Thomas Devane turned out as a volunteer as a nine months men and was chosen Captain to Command the Company of nine months men rased in New Hanover and Brunswick County, that the said Captain Devane did march said Company to Duplin courthouse and continued there with several other Companys till sometime in September then Colonel Armstrong came and furlowed the soldiers for six months but the said Devane did collect his Company and march them to head Quarters. The deponent acted as Sargent under said Captain Devane and after sometime being at head Quarters at Plescersburgh in South Carolina the said Devane was sent back to collect the furlowed men that had not complyed with orders. Maurcus Fennel Nicholas Fennel, before a justice of peace in Sampson County, December 24, 1793, made oath that on the first of June 1778 Thomas Devane was chose Captain to command a Company of nine months men, deponent being a soldier in said Company at Wilmington and the said Devane did convey said Company to Duplin Courthouse and continued there til September then Colonel Armstrong came and forlowed these men under the said Devane for six months but the said Devane call'd on in November in the same year collected his Company and marched to Elizabeth Town in Bladen County from thence to Pleussburg in South Carolina and delivered his Company to the Continental Officers. In Senate 21 Dec. and in the House 28 Dec. 1793 and referred to Committee. The Committee of Claims tax took under consideration the second time the petition of Thomas Devane and are of opinion that the following facts be laid under your consideration, first that he did command a company of nine months men, & that he continued in said service for fourteen months during the last war, which your Committee acknowledges is just, as set forth in said petition. Wherefore we conceive that a mature consideration of your body of this as well as all others of the same kind would save time in future and perhaps give satisfaction to all such Claimants.
