E 5, P. 484 Thomas AYRS of Duplin Co., to Isaac HINES of Dobbs Co., NC- 390 Acres 21 Jan 1778 This Indenture made the twenty first day of January in the year of Our Lord One Thousand Seven Hundred and Seventy Eight - Between Thomas AYRS of the province of North Carolina and County of Duplin of the one part and Isaac HINES of the province aforesaid and County of Dobbs of the other part. Witnesseth that the said Thomas AYRS for and in consideration of the sum of Twenty One pounds proclamation money to me in hand paid to Thomas AYRS by Isaac HINES before the unsealing and delivery of these presents the receipt thereof I acknowledged myself to be satisfied and paid every part - part an parcel thereof therefore have given granted bargained sold and conveyed and by these presents do fully and freely absolutely convey and confirm unto Isaac HINES his heirs executors administrators and assigns forever one certain tract or parcel of Land situate lying and being in the county of Duplin on the waters of the N East branch of Cape Fear and on Jones’s Swamp beginning at a pine, Sam’l ALBERTAN’S corner and runs S 65 E to a pine then straight line to a Red Oak, Hardy BENTON’S old corner tree then up the Swamp to the beginning being part of Three hundred and ninety acres taken up by John BECK, patent bearing date 1768 to have and to hold to the said Isaac HINES, his heirs, Executors, administrators and assigns together with all advantages woods ways waters and water courses and as for my part the aforesaid, Thomas AYRS, my heirs Executors administrators and assigns doth hereby covenant promise & engage unto the sd. Isaac HINES his heirs Executors and assigns that they shall peaceably and quietly hold use occupy and enjoy the aforesaid land premises with all the appurtenances and privileges to the same belonging free and clear of all encumbrances whatsoever and as for me the aforesaid Thomas YRS my heirs Exrs., administrators and assigns will forever warrant and defend the aforesd. land and premises as aforesd. to Isaac HINES his heirs executors, administrators and assigns against the lawful claim or claims of any person or persons whatsoever.
