Mason http://www.genrecords.net/emailregistry/vols/00022.html#0005225 April 8, 2022, 4:08 pm Source: Clerk Of Court Written: 1858 Transcribed by Sloan Mason slomas7@comcast.net Clerk of Court Vol. 2-4, p. 122-124 Duplin County, NC Will of Zilpha WILLIAMS of Duplin County, NC Written: 1 May 1858 Probated: 5 January 1878 I Zilphia WILLIAMS of the County of Duplin and State of North Carolina being of Sound mind and memory but considering the uncertainty of my earthly existence do make an publish this my Last Will and Testament in manner and form following that is to say: I give and bequeath to my Sisters, Elizabeth and Phebe WILLIAMS and the survivors of them all the property both real and personal of which I may be possessed at the time of my decease, said property being all my right, title and interest in all the property bequeathed to me by the Last Will and Testament of my father Stephen WILLIAMS. I hereby constitute and appoint my Sister, Elizabeth and Phebe WILLIAMS my executors to execute this my Last Will and Testament. In witness whereof I the said Zilphia WILLIAMS do hereunto set my hand and seal this 1st day of May A.D. 1858. Zilphia WILLIAMS(Seal) Signed, sealed published and declared to be her last Will and Testament in presence of us who at her request an din her presence do subscribe and names as witnesses thereto. WILLIAMS State of North Carolina Duplin County Probate Court January 5, 1878 I, Nancy WILLIAMS respectfully represents that she is the Assignee said interested by deed to a portion of the estate desired in the Will of Zilphia WILLIAMS and that said Zilphia WILLIAMS is dead, and that she offers the said Will and Testament for probate in your Honorable Court. II, First the nature of said estate and property consists of real and personal estate as follows: Real Estate: tot he value of an estimated $2000, and personal property of $400. III, The nature of the Testatrix’s property in real estate is such that it depends upon the fact as to whether or — Elizabeth WILLIAMS’S Will was efficient and operative to pass title to said Testatrix and did so pass said title to the testatrix to give title and right to the Testatrix of Phebe WILLIAMS. IV, The names of the parties entitled under the Will of said Testatrix is as follows: Nancy WILLIAMS, Ann WILSON, David JOHNSON, Nancy JOHNSON, Polly MOORE, Stephen PIERCE, none of whom are minors, David JOHNSON and Polly MOORE reside in the County of Pender and Nancy JOHNSON and Stephen PIERCE in the county of Sampson and the rest in the County of Duplin. SOUTHERLAND Probate Judge North Carolina Duplin County In the Probate Court January 5, 1878 The foregoing paper writing purporting to be the Last Will and Testament of Zilphia WILLIAMS, Dec’d is this day exhibited in Open Court for Probate by Nancy WILLIAMS And the due execution of the said paper writing is proven by the Oath and examination of H. F. MURPHY and D. H. WILLIAMS, the subscribing witness thereto, who being duly sworn, say that they saw the said Zilphia WILLIAMS sign said paper writing declaring it to be her last Will and Testament that they attested said paper writing in the presence of and at the request of the said Zilphia WILLIAMS, and that at the time of the execution of the said paper writing by the said Zilphia WILLIAMS they believe she was of sound and disposing mind and memory. It is therefore considered by the Court that the said paper writing, is the Last Will and Testament of the said Zilphia WILLIAMS, Dec’d and the same is ordered to be recorded and filed. J. D.
