Bertie COUNTY Bryan, William to Uzzell, Thomas - 1740 File contributed for use in USGenWeb Archives by Cathy Farris F133 & F136 William BRYANT to Thomas UZZELL Bertie 1740 Know all men by these presents that I William BRYANT in Edgecomb County in North Carolina am held and firmly bound unto Thomas UZZELL of Nansemond County in Virginia his heirs executors adm and assigns in the fair and just sum of one thousand pounds province bills of North Carolina to which payments will and truly to be made I bind my self my heirs executors & adm firmly by thiese present sealed with my seal and dated tis 20th day of May 1740: The condition of the above obligation is that I the said William BRYANT his heirs executors adms do warrant maintain and forever defend secure and make good apure? and an indefeasable? title in fee simple of in and to a certain parecel plantation or tract of land scituate lying upon the northside of Meherrin River being the plantation where James BRYANT formerly lived and part of the patent granted to Richard BRASSWELL and also one hundred acres of land bought of John DEW by dec'd bearing date the 25 day of July 1730: against the said William BRYANT or his wife or against their heirs and against all P_____ whatsoever laying any clains therein to: or is anypart thereunto belonging or in any wise appertaining then. The above bond shall be void and of no effect other wise to hand? and remain in full force power and virtue of law W BRYANT & a seal signed sealed and delivered in the presence of us said UZZELL Thomas WHITFIELD BAKER Bertie County __ August Court 1740. The above bond was acknowledged in open court in due form of law which on motion is ordered to be registered. F136 BRYANT to UZZELL This indenture made the 20th day of May in the fourteenth year of our Sovereign Lord George the Second by the grace of God of Great Britain France and Ireland King Defender of the faith anno: Dom 1740 Between William BRYANT of Edgecombe County In North Carolina planter of the one part and Thomas UZZELL of Nansemond plnater of the other part. Witnesseth that the said William BRYANT for and in consideration of the sum of twenty five pounds current money of Virginia to him in hand paid by the said UZZELL at or before the ensealing and delivery hereof this receipt whereof the said William BRYANT doth hereby acknowledge and thereof acquitt & discharge the said Thomas UZZELL his heir exes & adms the said William BRYANT hath granted bargained sold aliened & confirmed unto the said Thomas UZZELL his heirs and assigns a tract or parcel of land or plantation whereon James BRYANT decd formerly lived on containing three hundred and twenty acres of land it being part of a patent granted to Richard BRASSWELL for six hundrend and forty acres bearing the date 24the day of November 1706 which patent being endorsed to James BRYANT Sen the fourth day of March 1708 and recorded in Chowan County (Viz: begining at a poplar the beginning of the patent and runing NE 320 poles to a pine thence 69 degrees east 195 poles thence sw 320 to the mouth of a deep bottom that lies betweenthe plantation whereon said BRYANT formerly lived & John DUKES then to the first station the same being three hundred acres of land more or less which said land was given to the said William BRYANT by his father James BRYANT dec'd and also one hundred acres of land which I bought of John DEW by deed bearing date the 25th day of July 1730 begining at a Spainish oak in the head line between John DEW and James BRYANT plantation thence runing sw to a sweet gum ont he pocoson side thenthe due course to the river s up the River to BRITTS corner s up BRITTS line to a poplar called James BRYANTS corner tree s along a new line to the first station. To have & to hold the said plantation peice or parcel of land with all & singular the appurtenances to the said Thomas UZZELL his heirs and assigns forever subject only to the paint of ____ arising? quitrents as by law are or ought to be paid and the sad William BRYANT for him self his heirs exes or adm doth covenant promise grant to ad with the said Thomas UZZELL his heirs and assigns that the above granted premises are free & clear of all charges and Incumbrances whatsoever and that the said WIlliam BRYANT at the ensealing and delivery of these presents above granted ith their appartenances of agood sure perfect and indefeasable? Estate of Inheritance in fee simple to him and his heirs forever and that the said William BRYANT hath in himself a good right full power and authority to grant bargain and sell the same with their appurtenances to the Tho UZZELL his heirs and assigns forever in manner aforesaid and that the said William BRYANT his heirs forever shall and all person whatsoever shall and will warrant and will forever defend the said tracks or parcels of lands from all persons whatsoever and will from time to time hereafter at the requestion cost and charges of the said Thomas UZZELL his heirs exe's make and execute such other and lawfull act & acts deeds & conveyances and assurenances in the law whatsoever for the further and better insuring making and conforming the premises with the appurtenances to the said Thomas UZZELL his heirs and assigns as by him or them or his other council learned inthe laws shall be devised for advised or required. In witness my hand this party above written to these presents have set his hand & seal the day and year above written. WBRYANT & a seal - sealed and delivered in the presence of the said UZZELL --Thomas WHITFIELD BAKER, Bertie County Aug Court 1740. This William does not name the wife Mary, she may have died by now, or is just not on this deed.
