In consideration whereof he the said [Willis Knight written but scratch out] Pitman Worsley for and in behalf of the said Sina Leggett hath agreed to indemnify the said Noah Leggett of and from all maintenance moneys to be by her the said SIna Leggett demanded or recovered against the said Noah Leggett as also of and from all contracts, debts and engagements whatsoever to be by her the said SIna Leggett in any wise contracted and which he the said Noah Leggett shall actually pay together with the charges touching the same in such manner as hereinafter is also mentioned: Now this Indenture Witnesseth that in part performance of the said recited agreement he the said Noah Leggett for himself his heirs, executors and administrators and for every and each of them doth hereby covenant, promise, grant and agree to and with the said [Willis Knight written but scratch out] Pitman Worsley his executors and administrators in manner as follows, to wit, that it shall and may be lawful to and for the said SIna Leggett his wife and that he the said Noah Leggett will from here forth so soon as the said SIna Leggett shall deem a separation necessary to her comfort and well being, permit and suffer her from time to time and at all times during her present coverture to live separate and apart from him the said Noah Leggett and to go and reside and be at or in such place of places, family or families and with such relations and friends as she the said Sina Leggett shall from time to time at her will and pleasure [not withstanding her present coverture] and as if she were a feme sole think fit: and that the said Noah Leggett shall not at any time or times here after compel the said SIna Leggett to cohabit with him, nor (sue), molest, trouble or disturb and person or persons whatever for the (word blurred), harboring or entertaining her, nor shall or will at any time here after during the said coverture or at her death claim or demand any effects in estate of any kind or nature whatsoever which she the said SIna Leggett at any time here after shall get, acquire or be possessed of or which shall be bequeathed, devised or given to her by any person or persons whatsoever and that she shall and may peacefully and quietly hold posses recover and enjoy the same to and for her sole and separate use benefit and disposal [not withstanding her present coverture] or as if she were a feme sole without any let, suit, trouble or interruption or disturbance whatsoever of or by him the said Noah Leggett his heirs, executors and administrators or of or by any other person or persons whomsoever lawfully claiming or to clam by, from or under him: And this Indenture further Witnesseth that to the and that the said Lena Leggett may have a competent support and maintenance during her lie from such time as the said separation may commence he the said Noah Leggett in full performance of his part of the said recited agreement and in consequence of such separation and of his being indemnified by him the said [Willis Knight written but scratch out] Pitman Worsley of and concerning the same in such manner as is here after mentioned and expected and at the request and by and with the consent, direction and appointment of the said SIna Leggett testified by her executing this deed and also in consideration of five dollars to him in hand by the said [Willis Knight written but scratch out] Pitman Worsley before the ensealing and delivery of these presents hath given, granted, bargained and sold, aliened, released, (insessed)and confirmed and by these presents doth give, grant, bargain and sell, alien, released, (inseass) and confirm unto the said [Willis Knight written but scratch out] Pitman Worsley a tract of land situate in the County of Edgecombe in the state aforesaid containing by estimation thirty three acres be the same more or less and bounded as follows by the lands of James W. Clark, David Barnes, Weeks P. Hadley and Cullen Adams And also the following personal property a Negro man named Joe aged seventeen years, one hog, two feather beds and furniture, (two) chests, one table, one pot, one loom, three chairs, one looking glass, one churn, one stand, one calf, five head of cattle, one pain of cart wheels, 2 wheels, woolen & linen, 1 pair cards, three plough, hoes, one axe, 1 grubbing hoe, 1 (fire dogs), one saddle and bridle to have and hold the said land to the said [Willis Knight written but scratch out] Pitman Worsley for and during the natural life of the said SIna Leggett wife of the said Noah Leggett and the said personal estate to the said [Willis Knight written but scratch out] Pitman Worsley his executors and administrators in trust nevertheless that so soon as the said SIna Leggett by writing under her hand executed in the presence of at least one witness who shall subscribe the same shall make known to the said [Willis Knight written but scratch out] Pitman Worsley that it is her wish that the said separation shall commence the said [Willis Knight written but scratch out] Pitman Worsley shall posses her of the said lands and personal estate to and for the sole separate and peculiar use, benefit and disposal of her the said SIna Leggett during her natural life in such manner as she at any time, not withstanding her present coverture, shall think fit without being accountable to any person or persons whatsoever for the same: And upon further Trust that in the event that the said Noah Leggett should die leaving the said Sina Leggett surviving him that the said Sina Leggett shall hold the said lands in lieu of dower in the lands of the said Noah Leggett and that she shall hold the said personal estate as a satisfaction of the share she may be law be entitled to in the personal estate of the said Noah Leggett and upon trust for the use after the said Noah Leggett until the said Sina Leggett shall make known her wish that the said separation shall commence as aforesaid- And the said Noah Leggett for himself his heirs, executors and administrators do the further covenant, promise, grant and agree to and with the said [Willis Knight written but scratch out] Pitman Worsley his heirs, executors and administrators in manner as follows, to wit, that he the said Noah Leggett now at the time of ensealing and delivery of these presents is lawfully rightfully and absolutely seized of the lands aforesaid and in a true, perfect and indefeasible estate of Freehold and that he hath a full, sure and perfect estate in the personal property hereby conveyed without any restraint, cause or matter whatsoever to defeat, charge, lessen or encumber them or either of them; And also that he the said Noah Leggett now hath in himself, good right, full power and lawful and absolute authority to grant, bargain and sell, release and convey all and singular the personal property hereby conveyed or intended to be conveyed unto the said [Willis Knight written but scratch out] Pitman Worsley his executors and administrators according to the true intent and meaning of these presents- That the premises hereby by conveyed or intended to be shall and may be peaceably, quietly had held and enjoyed according to the true intent and meaning of these presents without trouble, suit, denial or eviction or interruption by any person or persons whatsoever. And further that the said Noah Leggett his heirs, executors and administrators and each and every of them lawfully claiming any estate right title, trust or interest either in law or equity in the premises aby, from or under or in trust for him, shall and will at all times hereafter upon every reasonable request of the said Pitman Worsley or Sina Leggett or the heirs, executors or administrators or either of them, make, do, execute and perform all and every such further and other lawful acts, deeds, conveyances and apurances in the law whatsoever for the better and more perfect granting conveying and assuring the premises herein before mentioned and every part thereof according to the respective natures of the said estates for the purposes herein before mentioned as by the said Pitman Worsley or Sina Leggett, or the heirs, executors or Administrators of either of them or their or any of their Counsel learned in the Law shall be reasonably advised or required. And this Indenture further Witnesseth that the said Pitman Worsley in pursuance of his part of the said recited agreement for and on behalf of the said Sina Leggett to be done and performed and in consideration of such separation and of the estate made by him the said Noah Leggett to them of the premises herein before provided for the sale, separate and exclusive use, benefit and disposal of the said Sina Leggett, in manner as aforesaid doth for himself, his heirs, executors and administrators covenant, premise and agree with the said Noah Leggett his executors and administrators that he the said [Willis Knight written but scratch out] Pitman Worsley his heirs, executors and administrators shall and will from time to time and at all times after the said separation shall commence and during the continuance thereof will and sufficiently (save) defend keep harmless and indemnify the said Noah Leggett his heirs executors and administrators from and against the payment of all manner of debts whatsoever and of what nature or kind soever as well those which the said Sina Leggett after the separation shall have commenced and during the continuance thereof shall contact or make with any person or persons whatsoever and also form payment of all alimony or maintenance whatsoever, which she the said Sina Leggett may at any time here after during the continuance of the coverture and of the said separation have claim challenge as demand from the said Noah Leggett or his estate and likewise from all costs, charges, expenses and damages whatsoever which he the said Noah Leggett his heirs, executors or administrators shall or may at any time here after pay, sustain or be put into by the said Sina Leggett & contracting any such debt or debts or demands if any such alimony or maintenance aforesaid or for, by reason or in respect of any other cause matter or thing whatsoever which may be born, pain or sustained by him the said Noah Leggett touching or concerning her the said Sina Leggett living separate and apart form the said Noah Leggett.
