Armstrong on the 7th day of March 1864 has been sold under execution & there is a controversy regarding the title to the same, wherefore I Henry H. Sherley hereby bargain sell & release all my right title & interest in & to the said land & for a greater certainty reference is hereby made to the deed of said W.W. Armstrong registered in Book No 28 page 664 now in consideration of the premises & one hundred & fourteen dollars & fifty six cents I hereby bargain sell & release my entire interest in the land to Joshua Killebrew & his heirs. Mercer; At Spring Term Court of Equity 1851, Martha E Braswell, Rufus Braswell, Mary A. C. Braswell & Lousia D. Braswell by their guardian and next friend, Thomas Newby filed a petition asking for the sale of four tracts of land of which their father, Duncan L. Braswell died seized and possessed of and same court ordered the clerk & master of said court should sell the said tract of land at public auction; auction was held on 30 Apr 1851 and John R. Mercer was high bidder for first tract at $221, Elisha Landing was high bidder for second tract at $85 and they entered into bonds which sale was approved by the court; the master rejected the sale and a resale was ordered by the court; resale was held on 25 May 1852 and John R. Mercer was high bidder at $175 for both tracts which was accepted by the court; clerk and master, Kinchen H. Lewis, did not make a deed at that time, court has now ordered new clerk & master, John Norfleet to make a deed to John R. Mercer for the two tracts of land, tract #1 beginning at the late (Benj Braswell) corner Mercers Mill Branch then along an agreed line between the late (Benj Braswell) & Zadock Braswell to a Spanish & red oak in the late John Williams line, now dead, then along said David Williams line to his corner in the Spring Branch then down the various courses of said branch to Mercers Mill Branch then down the various courses of the said mill branch to the beginning, containing 34 acres, the second tract beginning at an oak in the said Duncan Braswell line then north 270 poles to a stake and pine Joseph Lancaster's line formerly then along his line west 51 poles to a stake and post oak in said line Blount Williams corner then along his line south 267 poles to an oak in the line of the said Duncan L. A. Basett for $400, a tract on Hendricks Creek and on the west side thereof near Tarboro on the public road leading from Tarboro to Wilson adjoining the "other land of said Margaret Ann of H.T. Clark," beginning at Hendricks Creek at the western abutment of the bridge on the said public road then up and along the said road south 62 west 5.60 chains to the corner on the road then along a lane called Baker Street south 31 ½ east 5.71 chains to another corner then north 63 ½ east 5.73 chains to said creek and then up and along the "various courses thereof by nature" to the beginning, also another tract within the limits of Tarboro on the east side of said creek adjoining the piece also described and bounded by the natural courses of said creek and by a ditch which changes the courses of water except when the creek is full the said ditch having been cut to change the course of the said stream the said two pieces of land containing 3 acres, signed A.H.
