Maloney] In the name of God Amen. I Charity Benton of the county of Edgecombe and State of No. Carolina do constitute and ordain this to be my last Will and Testament, in form following (viz) My Will is that after my death my Exe’s herein after named proceed to sell all my pro- perty and the proceeds arising therefrom to be divided in the following manner ~ My son JAMES BENTON is to have one third part of the whole amount. My reason for it, is he has attended to my and my business. My Daughter PHERUBA WARD to have twenty shillings. My reason for not giving her more is, I think I have already given her equal to a distributive shares. My Exo’r is to purchase for my grand Daughters SALLY NICHOLSON and EVELINA B. BENTON a dress each. The balance is to be divided into six equal parts, my son ALLEN KNIGHT is to have one, my Daughter POLLY CORBIN is to have one, my grand Children by my deceased daughter SALLY PACE to have one, My grand sons by my deceased son KINDRED KNIGHT to have one, if either is living at the time of the division, my grand son by my deceased son JOHN C. KNIGHT to have one, if living, and my grand daughter by my deceased daughter ELIZABETH NICHOLSON to have one share if living. Now in case either of my last named grand children or my grand sons by my deceased son KINDRED KNIGHT should die before they arrive to the age of twenty one years or marries their part is to be divided on the principle of the division of the whole - My Will also is that my wearing apparel be divided between my daughter POLLY CORBIN and my daughters in law POLLY KNIGHT and ELIZA BENTON but if one or more of them should die before a division the survivors or survivor is to have them. I appoint my son JAMES BENTON Executor to this my last Will and Testament hereby revoking all former Wills by me made. In testimony whereof I have hereunto set my hand and Seal this 5th day of April 1818 Witness her John Jenkins Charity [C] Benton (seal) William Howenton + mark Edgecombe County August Court 1818 The within last Will an Testament of Charity Benton dec’d was exhibited in open Court for Probate and was proven by the oath of William Howenton one of the subscribing witnesses thereto. And James Benton the sole Executor named in the said Will was at the same time qualified thereto. Ordered that the same be certified and the Will recorded. Test. E. Hall Clk NOTE - her son and executor, James Benton, died in 1821, and another documents in the loose estate file shows that in 1823 "Solomon Ward & Wife" recovered a claim of $35 against the then executor, Spier Whitaker.
