(1850), commissioners John Braswell, William D. Mercer, John Mercer. Petition for dower, Feb. Ct. 1847, Rhoda Braswell vs Cally S. Robert, Cyntha P., and Milly Braswell states that she is the widow of Benjamin Braswell who died in 1847, intestate and was possessed of a tract of land adjoining the lands of John and William Mercer containing 200 acres adjoining the lands of Zadock Braswell, and a tract of land containing 190 acres adjoining the lands of Duncan Braswell and others; the above named defendants are the only heirs of said Benjamin. Nov. Ct. 1847, petition of Rhoda Braswell, Robert Lancaster and wife, Cyntha, and Milly Braswell, all of full age except Milly who sues in his half by Rhoda Braswell, her next kin vs. Robert Braswell and Cally Braswell who are infants without guardian and defend by order of court, petition states that Rhoda is the widow of Benjamin Braswell and the other parties to petition are the children of said Benjamin except Robert Lancaster who intermarried with petitioner (Prenety) and they are all tenants in common of said Benjamin and ask that slaves Lewis, Gilly, Any, Warren, Amos, Lettice, Albert, Baston, Esther, Ander, Prissy, Charlotte, Eliza, Drew, Hilliard, John, Elisha, and Lina who came to them from the said Benjamin; all are of full age except Milly who will be of full age before the next term of court; petitioners ask court to appoint commissioners to divide slaves; Nov. Ct. 1847, petition to divide land, Robert Lancaster and wife, Prenetty and Milly Braswell an infant and Robert and Cally Braswell who are also infants and sue in this behalf by their next friend and guardian, Rhoda Braswell, petition states that they are the heirs at law of the late Benjamin Braswell and tenants in common to land descended to them from their ancestor the said Benjamine to wit a tract known as the upper tract lying on Mercer’s Mill Branch containing 200 acres adjoining the lands of Lamon J. Dunn, Duncan Braswell, Elijah Williams and others also another tract containing 258 acres lying on Mercer’s Mill Branch adjoining the lands of John Mercer, William Mercer, Zadock Braswell and others, they also state that Robert Lancaster married Prenethy is of full age and that Molly will be of full age and that the “others will respectively be of age in one year and two years and Rhoda Braswell their mother guardian and next friend have with view of saving expense of future divisions joined in this suit” the other petitioners having nearly reached the age that the law allows them to take control of their property, petitioners ask court to appoint a commission to divide the land and slaves into equal value shares.
