Armstrong, Polly Calhoun, Willie G. Barnes and his wife, Mary E. Barnes, James G. Armstrong, Chrissy Armstrong, and George W. Armstrong, the last three being infants and suing in their behalf by their next friend, ( ) Norfleet, the Clerk Of Court, Ex parte, state that James Braswell, late of this county departed this life about the year (blank) having made a will devising all his land to his wife, Crissy Braswell during her lifetime or widowhood and after her death or marriage to his son B. Braswell in fee, that the said will also containing the following clause; “after the death or marriage of my wife, my will and desire is that all the residue of my estate not already given away be equally divided among my four daughters, Harriet, Polly, Betsy and Crissy Braswell” that the said Henry B. Braswell and Crissy Braswell the child both died during the lifetime of the said testator without issue; said Harriet, Polly and Betsy were the only surviving children and heirs at law and entitled to said lands after the termination of said Crissy, the widow of said testator; that the said Polly Calhoun is a child of the said testator and unmarried, that the said Harriet died unmarried and intestate and that the said Betty is dead leaving your petitioners Mary E. Barnes, who is the wife of said Willie G. Barnes, James G. Armstrong, Crissy Armstrong, and George W. Armstrong her children and only heirs at law and that said William J. Armstrong under a decree of court became the purchaser of the undivided interest of the said Harriet and has a deed for such; the said Crissy, widow of said testator has recently died; land consists of two separate tracts in Edgecombe Co., one lying on the north side of Mercer’s Mill Branch adjoining the lands of the devisees of David Baker, Jesse Mercer, Denson Brown and others containing (blank) acres, the other adjoining the lands of Hillery Peel, William G. Bullock, James Hinton and others containing (blank) acres; petitioners ask for commissioners to divide said land as follows: one part to William J. Armstrong, one part to Polly Calhoun, and the other part to the others. Feb Ct. 1853, petition of Polly Calhoun, William J. Armstrong, David Williams, James B. Thomas in right of his wife, Frances Thomas and Nancy C. Whitehead, an infant who sues by her guardian the said Jas. B. Thomas, Ex parte, stating that James Braswell died about 1825 and bequeathed all his slaves to his wife, said Chrissy during her life and after her death to his four children, Harriet, Polly, Betsy and Crissy Braswell, that said Crissy, the child died before the said testator without issue, her legacy lapsed and her share was vested in the other three; Crissy, the executrix (asseted) to the (bequeaths) of the said slaves to herself and the other persons, that petitioner Polly Calhoun is the widow of Orren D. Calhoun who died during the lifetime of said Crissy, the widow, and (one of the children of the said testator), that petitioner William J. Armstrong married the said Betsy who is dead and that he is her administrator and the said Harriet married one James Whitehead who died in the lifetime of the said Crissy leaving her surviving him and that the said Harriet is dead and said Jno. Whitehead (sic) is her administrator and the next of kin of said Harriet are her children, to wit Frances Thomas, wife of petitioner the said James B. Thomas, your infant petitioner the said Nancy C. Whitehead and James H. Whitehead and William A. Whitehead; the said James H. Whitehead hath sold his undivided interest in said slaves to (William) Lancaster who hath sold it to your petitioner David Williams; William H. Whitehead has sold his interest to William J. Armstrong, John Whitehead as administrator of the said Harriet is willing to deliver his share of slaves to the persons entitled to receive them; said Crissy has recently died; slaves have increased in number and their names are (Quinny, Charles, Blount, New, Lewis, (Proch), Berry, (Anneky), Lisette, Larry, Redin, Ann, Austin, Frenetty, Lucinda, Matilda, Lettice, Fliva, Harry and Henry; petitioners ask for commissioner to effect division of slaves as follows: one part to said Polly Calhoun, one part to William J. Armstrong, one part to be divided into four parts with one part to David Williams, one part to William J. Armstrong, one part to James B. Thomas, and one part to Nancy Whitehead. Edgecombe Co.
