PETITION (Mar Ct. 1846) of William Bridgers, Reddin Bridgers, Mary Ann Bridgers, Thomas H. Bridgers, John Bridgers, Sally Ann Bridgers, Joseph J. Bridgers, all of whom are infants and petition by their guardian, James Bridters and of William D. William D. (Summerlin), (Lucinda ( ), Wm. F. (Hair) and wife, Jane, Arthur Knight and wife, Susan, Calvin Summerlin of age, ( ) Summerlin, Alford Summerlin, and Sarah Summerlin, infants who sue by there next friend, Henry T. Clark complain that Josiah Freeman, late of Edgecombe Co. departed this life (3 words) having made his last will and testament and executors named therein refused to qualify; Jesse C. Knight was appointed administrator; will containing the following: the Rhods tract of land & the place I bought of ( ) be equally divided between the children of Elizabeth Summerlin and William (Bridgers); that the said Jesse C., doubting his authority to sell land and it remains unsold; petitioners William F., Reddin, Mary Ann, Thomas H., John, Sally Ann & Joseph ( ) are the children of the said Millicent Bridgers and petitioners William D. Summerlin, (Jane Hair), Susan Knight, Calvin, Pheasantan, Alfred and Sarah are the children of the said Elizabeth Summerlin who (3 words) at the death of the said testator; petitioners ask for sale of land. NOTE: THIS DOES NOT MENTION ROBERT R. BRASWELL, DO NOT KNOW IF IT IS IN WRONG FOLDER OR IF THERE IS A CONNECTION TO ROBERT. PETITION of James H. Draughon and Arretta, his wife against Benjamin G. Braswell, Anselina Braswell and John D. Braswell, Robt. R. Braswell, late of Edgecombe Co. died sometime during the year of 1845 testate, Benj. G. Braswell qualified as executor and took possession of the personal estate which was more than needed to pay debts and expenses and legacies; testator gave his estate to the following persons: Anseylina Braswell, his widow, Benj. G. Braswell, Joseph J. Braswell, Arretta Braswell, Anselina Braswell and John D. Braswell and Margaret Braswell (wife of Luston Cobb), children of the said testator; one legacy was to “my daughter Arretta Braswell one negro boy Champion to her and the heirs of her body”; after the legacies were given, the testator willed that all the residue of the estate be sold and paid to his living children and their heirs when they arrived at the age of 21 years; at the Aug. Ct. 1851 executor Benj. Braswell was in possession of $2900.12 which; James Draughon, in right of his wife petitioned for her share of the money and the negro Champion; executor has retained his own legacy and paid the said Joseph J. Braswell, Thos. P. Braswell, Robt. S. Braswell, Margaret Braswell, the wife of (Zustor) Cobb, Elizabeth Braswell and Anzalina, the widow of testator and holds the shares of John D. Braswell and Anzelina Braswell, they being under the age of 21. COMPLAINT OF WILLIE WALSTON (Spring Ct. 1853), trustee of Loseton Cobb vs. Benjamin G. Braswell, Joseph J. Braswell, Thomas P. Braswell, Robert S. Braswell, John D. Braswell, Aretta Braswell, Ansey Laney Braswell, children of Robt. R. Braswell and the four last of whom are infants and Anseylina Braswell, widow of said Robt. R. Braswell, Leaston Cobb and wife, Margaret; Robt. Braswell, late of Edgecombe Co. died testate; Benj. G. Braswell qualified as executor and Joseph J. Braswell, also named in will as co-executor, refused to qualify; a large sum of money and effects have come into the hands of said Benj. Braswell, to wit many thousands of dollars, from estate of Robert; Walston has repeatedly asked Benj. Braswell to settle with him for the part of estate assigned to him by said Cobb and said Braswell has refused to do so; Walston asks court to make Banjamin Braswell account for Walston’s interest in the estate and pay said interest to Walston. ANSWER to complaint of Willie Walston, trustee of (Leaston) Cobb, complaint is correct that Margaret Braswell received negro Cherry and $100 from her father’s will and that she married (Leaston) Cobb, that the children are correctly named in the complaint, there has been a division of the estate of the mother of the testator and Winny Williams and the slave of the testator has come into the hands of this defendant, that Elizabeth Braswell, one of the children of the testator died in the lifetime of the testator without issue, that each devisee’s share was to be held until they reached the age of 21, the executor paid a note against the said Cobb at his request as set forth in exhibit “B”and he has no knowledge of any note except the one for $200 that he paid, NOTE: this paper is hard to read, may need further examination. RULING, there is due Leaston Cobb $178.27 in right of his wife, Margaret and to (B.G.) Braswell $73.05. PETITION of Martha E. Braswell, Rufus H. Braswell, Mary A.E. Braswell & Lousia D. Braswell, infants suing in this by their guardian, Thomas N. Newby; Duncan L. Braswell, late of Edgecombe Co. died intestate and was at the time of his death seized and possessed of several tracts of land , one tract known as the Betsy Griffin land beginning at a red oak then south 108 poles to a maple at or near the run of Mercer’s Mill Branch then down the various courses of said branch to an elm then north 133 poles to a gum and oak then west 72 poles to the first station, containing 53 acres, also another tract beginning at Benjamin Braswell’s corner Mercer’s Mill Branch then along an agreed line between the said Benjamin Braswell and Zadock Braswell to a Spanish and red oak in John Williams’ line (now dead) then along said Williams line to his corner in the Spring Branch then down the various courses of said branch to Mercer’s Mill Branch then down the various courses of the mill branch to the beginning, containing 35 acres, also another tract beginning at a stake and small oak John Braswell’s corner in Henry Austin’s line then along said line north 2 1/4 east 144 poles to a pine in Benja. Braswell’s line then along said Benjamin Braswell’s line east to a pine stump and small red oak Braswell’s corner then north 4 east 18 poles to a water oak on the run of Mercer’s Mill Branch near a corner ash then down the various courses of said branch to a sweet gum a corner made the second of August 1837 then south along a new line 148 poles to a pine stump in John Braswell’s line then along said line west to the beginning, containing 85 acres, also another tract beginning at an oak in Duncan Braswell’s line then north 270 poles to a stake and pine Joseph Lancaster’s line then along his line west 51 poles to a stake and post oak in said line Blount Williams’ corner then along Blount’s line south 267 poles to an oak in Duncan L. Braswell’s line ,his heirs, then along this line 57 poles to the beginning containing 85 acres and known as lot # 7 in the division among the heirs of John Williams, all of which land descended to the heirs at law of the said Duncan L. Braswell who are his children to wit Martha E. Braswell, Rufus (H) Braswell, Mary A.E. Braswell, and Lousia D.
