PETITION- Ernest Daughtridge, a minor, suing by his general guardian, George Hackney states that W.M. Daughtridge the grandfather of Ernest, died intestate in the year 1894, domiciled in Nash Co, seized and possessed of divers tracts of land, some in Nash Co. and some in Edgecombe Co., which was duly partitioned amongst his heirs at law in a Special Proceeding in Nash Superior Co. One tract containing 117 77/100 acres situated in South Rocky Mount owned by the W.M. Daughtridge estate dated May 22, 1894 was assigned in severalty to the petitioner, Ernest Daughtridge, being commonly known as the Lancaster Tract, bounded on the north by Lancaster Street, and on the west by the W&W R.R. canal and lot #4 in the plat above mentioned, on the east by the lands of Mrs. Hargrove, on the south by Tyan Cokey Swamp and the lands of land company and on the west by the lands of the W&W RR Co., saving, reserving and excepting one acre heretofore dedicated and used for the burial of the dead, valued at $5000, Ernest Daughtridge is under age, being (14) years old and that said George Hackney was appointed his guardian on the 14th day of May, 1894 before the Superior Court Clerk of Wilson County; petition is to sell land as contracted, subject to the approval of court to W.H. Whitehead in the sum of $5800 and Whitehead to pay all costs of this special proceeding, there is a house on the property but it is not very suitable for living, being so close to the tracks where trains are constantly shifting, signed Dec. 21, 1897, Jacob Battle, Atty for guardian. (C)L. Daughtridge states that he has read petition and agrees with the sale to Dr. W.H. Whitehead. Several people, being sworn, say that they are acquainted with land and agree with petition, signed by J.B. Lancaster, D.D.D. Daughtridge, (L.V.) Bassett, Thos. H. Battle, Jas. H. Chapman, J.H.
