Proctor, Ephraim Daws & others & containing 499 acres and that he left (surviving) as his heirs at law the above named defendants who are his children & who are infants without guardian. Daws, Benjamin, 1847, summons to commissioners to lay off widow's dower for Nancy Daws, widow of Benjamin who died in possession of 499 acres of land adjoining lands of William (Proctor), Ephriam Daws, and others. Feb Ct. 1848. DOWER- Land was allotted on 7 (Jan) 1848. Fee to surveyor was $5. Commissioners were Elijah Williams, Jas. H. Armstrong, Elza Taylor, Thomas Curls, Amos (Walston), William Proctor, Hines Cobb (X), Hilyard S. Taylor, Jacob D.D. Robbins, John W. Robbins, J.W. ( ), Meret Joyner, beginning in Tyancogue Swamp where the rail road crosses then along the rail road to the county road then along the county road to William Proctor's line then and said Proctor's line and Petways line to Tyancogue Swamp then up the various courses of said swamp to the beginning, containing 183 acres, including the dwelling house out houses where the dec'd most generally dwelt next before his death, 7 Jan. 1848. Elmore and wife, Mary T. Elmore, J.R. Boswell and wife, Fannie G. Boswell and James S. Scott vs. George W. Dawes, petitioners are tenants in common and in possession of a tract of 81 acres of land in Gardners Township, Wilson Co. adjoining the lands of F.W. Barnes, J.R. Boswell, W.B. Whitehead and others, known as the :Betsey Dawes Home Place; the interest of petitioners, Martha Peel, Jesse Scott, Mary T. Elmore, Fannie G. Boswell, James S. Scott and the defendant, George W. Dawes have an undivided one sixth interest in said land and each is 21 years of age or older; owing to small number of acres the land is best divided and proceeds divided among owners; Betsey Dawes died in 1899, leaving as heirs, brothers and sisters, Martha Peel, Jesse Scott, Mary T. Elmore, Fannie G. Boswell, James S. Scott and Zilphia Webb, wife of John Webb; said Zilphia, sold her share to the defendant, George W. Dawes; Betsey Dawes, at the time, Betsey Bass, wife of Bennett Bass, and her husband, executed a note for $177.25 at 8% interest to John D. Scott on 30 acres of said land; note was transferred to J.C. Hadley who brought suit against G.W. Dawes, administrator of Betsey Dawes and her heirs at law for the said sum plus interest and for foreclosure of said mortgage; said Hadley transferred said judgement to F.T. Peel, J.P. Elmore, and Jas. S. Scott who are now owners of same, there has been paid $141.97 on said note and balance is now due; petitioners ask for sale of the land and proceeds, after note is paid to be divided among them, March 31, 1904, signed F.T. Woodard; Elizabeth Daws late of Wilson Co. died intestate during the year of 1899 seized and possessed of a tract of land in Gardner's Township beginning on the new road at Elizabeth Bass' Corner then along said road north 67 deg. 36 min. east to a lightwood stake a new corner then with a new marked line north 41 deg 21 min. west 132 poles to a stake in the back line then with said line south 67 deg 36 min. west to a stake said Elizabeth Bass' corner then with said Bass line south 46 deg 24 min. west 132 poles to the beginning, containing 30 acres; the feme plaintiff, Fannie S. Daws that if the other brother and sisters were willing to let him live on land for his lifetime, they would do so as well; said G.W. Dawes died 13 July 1913 testate leaving a will naming defendants as his executors; for many years before his death, John D. Dawes had handled sums of money for plaintiff; John D. Dawes owed plaintiff $800 of this money at the time of his death; plaintiff does not have a receipt for this money but asks court for judgement in his favor to recover money from estate of John D. Wynn and wife, Catherine, A.J. Daws (possibly A.S. Daws). Very hard to read. Apparently W.D. Daws sold land to A.S. Daws for $175 to raise money to pay debts. REPORT- Feb Term 1870, W.B. Daws, administrator of Jno. R. Daws, vs. Nancy Daws (and others), pursuant to an order of ( ) I exposed the land to sell on the (premisesies) on 25 May 1870 to the highest bidder, at which sell A.G. Daws became the ( ) at $175 for the 50 acres of land ( ) to the dower of Nancy Daws, covering a large portion of the tract, the money to be paid on six months credit, ( ) 24 1870, W.B. Daws. Dawes; administration was granted to petitioner to the estate of deceased and funds are insufficient to pay debts of said deceased, debts are about $500, charges for administration are about $150 and value of personal estate are about $150, the deceased died seized and possessed of a tract of land upon which he lived adjoining the lands of Eaton Gay, Susan Dawes and on the W& W Railroad in aforesaid county, formerly belonging to Benjamin Daws containing 50 acres, the defendants together with petitioner are tenants in common to said land, petitioner asks for sell of property to pay debts of deceased, signed W.B. Dawes is entitled to administer estate, valued at $3000 and is listed as only heir of Lula B. Dawes; signed J.D. Dawes, 22 July 1893. Daws, Martin, 1881, PETITION- Edgecombe County In the Probate Court, in the matter of the estate of Martin Daws; (S) B. Williams being duly sworn says that Martin Daws late a resident of this county left the state many years ago, to wit, twenty five years and that he has not been heard from by his family ( ) to this applicants knowledge or information by any one else in more than seven years, that this applicant does verily believe that the said Martin Dawes is dead, that at the time of leaving the state as aforesaid the Martin Dawes was the father of five children (four written first and marked out), Hilliard Dawes, Reddin Dawes, Margaret A. Williams wife of applicant, S.O. Dawes & Catherine Dawes, of whom Reddin Dawes is dead, leaving five children & Catherine Dawes is dead without issue; that the said Martin Dawes was entitled to a share of estate of his father, Ephraim Dawes, now in the hands of (Lucy) Dawes Admx of Reddin Dawes (dec'd) former Admin. of said Ephraim Dawes; that the value of said estate is supposed to be about sixty five dollars; that the said Ephraim Dawes died in the county of Edgecombe and his letters of Administration were issue ( ) his estate by the proper court of said county; that your applicant desires at the ( ) of a majority of the children of said Martin Dawes to administer in the estate of the said Martin Dawes. Dawes, Miles, 1903 estate file- FINAL ACCOUNTING- Harriet Dawes, admix. Of Miles Dawes, dec'd, she states that no property of Miles Dawes, deceased has come into her hands except what was allotted to her for her year's provisions by O.B. Proctor, JP and Chas. Daws of Kemper Co., Miss. appointed John Daws of Edgecombe Co. as his attorney to handle his affairs involving the estate of Susannah Daws, late of Edgecombe Co., 29 May 1875. This file appears to be for Susannah Daws with R.B. as administrator. Another file is marked R.B. Daws, 1891. GUARDIAN'S OATH- Henry C. Robbins, stated that Geo. T. Daws and Charles F. Daws are orphans and minors and that he is the person entitled to letters of guardianship, estate is valued at about $25, Jan 9, 1891, he is appointed guardian of Geo. And Charles, oprhans of R.B. Parties to this suit are tenants- in- common and seized and in possession of a tract of land containing 62 acres beginning at a small black gum, corner of lot #2 in Tyan Cokey Swamp near the railroad then south 157 « poles to a lightwood stump in the bay pond, corner of lot # 2, north 74 east 54 poles to a stake, Catherine Robbins' corner, then north 87 east 117 poles, north 20 west 48 poles to a black gum in the swamp, Hilliard Taylor's corner then up the various courses of said swamp to the first station; this description is taken from a division of the Ben Dawes land which was made by order of the court at Nov. Term 1852, of Edge. Co., it being lot #3 of said division, being the tract which descended to Susan Dawes from her father, Ben Dawes and upon the death of Susan Dawes to the parties named in petition; 2. Co; Thelma Bryant is a minor without guardian, living with her father, Dom Bryant in Edge. Co.; Jather S. Wynne, Leonidas B. Wynne, William Franklin Wynne and Evelyn Octavia Wynne are minors without guardian, living with their mother, Emily Wynne at Washington, NC; Lula Dawes, Jesse Dawes, Willie Dawes, Annie May Dawes and Ralph Dawes are minors without guardian, living with their mother, Annie E. Dawes at Genoa, Florida. DECREE- M.B. Dawes appointed as commissioner to sell land, and sold at public auction on Sat. Nov. 4, 1916 to B.F. Lancaster for $3380. Apparently there was further suits in this matter as W.E. Parrish, W.E. Proctor, SR. (possibly W.C.) And S.
