Edgecombe County, NC - Willss - Webb, John Sr. - 1841 File contributed for use in USGenWeb Archives by Jo Webb LAST WILL AND TESTAMENT OF JOHN WEBB,SR EDGECOMBE COUNTY In the name of God Amen: I JOHN WEBB,SR being of sound mind and memory, but weak and feeble and advanced in age, do ordain and make this my last will and testament, after recommending my soul to God that gave it and my body to be decently buried after death by my friends and executor herein after named. Item 1. My desire is that my beloved son DAVID WEBB have the following parcels or tracts of land (to wit) 1st tract known as the ANDREW OWENS tracts, whereon I now liveth, about two hundred acres more or less. 2nd STEPHEN HARRELL tract adjoining my home tract and the Rakestraw tract and others, about ninety-five acres more or less. 3rd EDWARD GUINN tract about ninety-five acres adjoining the DEMPSEY WEBB tract and my home tract. 4th Tract known as the BRAZIER land on the South side of the Mill Pond adjoining the HADDOCK land about one hundred acres more or less, also my Grist Mill with all its properties thereunto belonging. Item 2. My desire is that my son WM WEBB have one tract of land known as the EASON land whereon he now liveth adjoining the lands of W PATE and others about one hundred and eighty acres more or less. Item3. My desire is that my son DEMPSEY WEBB have one tract of land known as the GAY land adjoining his land whereon he now liveth, about ninety-five acres more or less, also I give unto him one Negroe fellow known by the name of ABRAM. Item 4. My desire is that my son JOHN WEBB have one tract of land known as the ELISHA FELTON tract adjoining his own land on the Mill Pond about ninety five acres more or less, also I give to him Thirty-five dollars in money to be paid by my executor or Adm. to make his land about equal with the other heirs not yet named. Item 5. My desire is that all my lands not heretofore given away be equally divided by three judicious persons to be chisen by my Executor, between POLLY WALSTON, WILLIE WEBBS children (to wit) WEALTHY, DELPHA, REDDIE and ELI WEBB and CYSSY WEBB to receive one fifth of one third of the lands and CHARLOTTE HARRELL one third of the lands. Its to be understood the lands not disposed of be divided in three shares and one share in five parts, and the following named Negroes to be disposed of in the like manner (to wit) Negroe woman CATE, DICK, SHARPER, SAM and CATE'S increase if any to be divided in like manner, say six divisions and one in five shares (to be divided namely) JOHN WEBB, POLLY WALSTON, WILLIE WEBB, children with CYSSY SMITH, DAVID WEBB, WILLIAM WEBB, CHARLOTTE HARRELL. Item 6. My desire is after my just debts is paid and the legacy of thirty- five dollars paid, all my perishable estate first sold upon a credit of six months and the net proceeds to be equally divided in seven equal parts and paid as follows to my beloved Children and Grandchildren: DEMPSEY WEBB, JOHN WEBB, WILLIAM WEBB, POLLY WALSTON, CHARLOTTE HARRELL, DAVID WEBB, WILLIE WEBBS children including CYSSY SMITH, five in number names heretofore mentioned to receive one Seventh part, then that to be equally divided between them the foregoing legacies is to them and their lawful heirs forever. I do constitute and appoint JO.
