H. HARRELL, ET AL.) To the Superior Court of Edgecombe County: The petition of Temperance Harrell, widow of William Harrell, deceased, respectfully showeth to the Court: That William Harrell, her said husband, died intestate on February 25th, 1903, domiciled in said County, leaving surviving him the following children: (1) John H. Harrell, (2) Amy Boyette, wife of Ferd. Boyette, (3) the children of his deceased son Thomas Harrell, to wit: Carrie Harrell married, W. B. Bradley, Lillian Waters, married Ed. Waters, and Tommy Harrell, the latter being a minor above 14 years of age, and without general guardian, (4) Jos. B. Harrell, (5) Geo. W. Harrell, (6) Mac G. Harrell, (7) Caswell Harrell, (8) Mary Francis Harrell, married W. M. Savage, (9) The children of his daughter, Alice Harrell, who married Jno. B. Cummings, and died leaving William Cummings, Richard Cummings and Benjamin Cummings, as her only children and heirs at law, and they are minors without general guardian. That the said William Harrell was seized and possessed in fee simple at the time of his death of the following real estate, to wit: A tract of land in said County, adjoining the lands of R. M. Mayo, F. M. Leigh, W. G. W. Leigh, Mrs. Geo. W. Harrell, Mrs. Mary A. Saunders and others, containing 223 acres, more or less, and on which he resided at the time of his death. Your Petitioner desires to have her dower in said lands allotted to, and to that end prays the Court to issue a writ to the Sheriff of said County, commanding him to summons Commissioners for that purpose in pursuance of the statute, to view the said lands and to allot to her one- third part thereof, including the dwelling house and all outbuildings and improvements appertaining thereto, and to report their proceedings in due form of law.
