John Deans had recovered from James Avent, administrator of Elias Boon in the sum of $40.91 and interest from 9 July 1825. Boon, and Nancy Boon, heirs of Elias Boon. Sumons was issued on 29 March 1826. Note attached stated that summons had been served on all defendants except Jos. Wimberly, his executor, the said Wimberly having renounced, Your petitioner was duly appointed his administrator with the will annexed and in said will and testament he disposed of his real estate. The same being devised to Lucy Clark, William Clark and Benjamin Clark, three of his children and his heirs— II- That said Benjamin, one of the devises therein named, died before the testator, without issue, whereby the devise, to said Benjamin lapsed; III- That some time thereafter during the year 1867, John Clark the testator died leaving surviving him the said William and Lucy, Benjamin having died as aforesaid and the devise as to him being lapsed, the real estate (embraced) in said lapsed devise, (de ) upon the testator’s heirs at law, to wit: Lucy Clark, Betsy Clark, Frank Clark, William Clark and Henry Clark. IV- And the said last will and testament was duly proved at (blank space ) whereby the above named heirs at law became seized of such real estate as was devised under said will and testament as tenants in common— VI- As your petitioner is informed and believes, the said devises Lucy and William, executed a deed to Betsy Brinn, said Betsy being one of testator’s children, whereby said Betsy was allowed to take an equal share of the real estate, devised in said will and testament, together with the said Lucy and William. VII- That the said Betsy Clark and one Isaac Brinn have since intermarried. VIII- That the said Lucy Clark and one Jno. R. Griffin have since intermarried. IX- That the said Frank having died his interest in said lapsed devise (devolved) on his heirs at law to wit: Edny Clark and Mary F. Clark, who has since intermarried with one Cooper Wells. X- That said Henry having died, his interest in said lapsed devise devolved upon his heirs at law, to wit: Amanda Clark, Margaret Clark and Wm. H. Clark. XI- That it became necessary to sell a portion of the testator’s real estate to pay his debts and his will having authorized a sale, the administrator with the will annexed, who was your petitioner sold forty five acres for this purpose the value of which was equal to one third of all the lands devised ( ) that the residue of the land passed to the two surviving devises, under the said will and testament as he is advised. XII- That the residue of said land consists of one hundred & eight acres adjoining the lands of Lucinda Clark and Thomas Norfleet & others and lying in Edgecombe County. XIII- That said William having died intestate, and your petitioner being duly appointed administrator took out letters of administration on said William’s estate. XIV- That said William’s estate is subject to the dower rights of said William’s widow, Lucinda Clark. XV- Your petitioner further showeth that a sale of said land, is necessary to enable him to pay the debts of his intestate and the charges of administration, amounting to at least $110 was the (2 words) to the end that said land maybe sold by your petitioner under a decree of this court and on such terms as the court may direct and that the proceeds of the sale may constitute assets in his hands for the payment of said debts and charges. The plaintiff alleges that 1- William Clark of said county died intestate a few years ago leaving him surviving the plaintiff who is his widow and no children. 2- That said intestate was seized and possessed at his death an undivided interest of a small tract of land situate in said county and that since his death a portion thereof has been allotted to his heirs adjoining the lands of Lucy Griffin and others and containing 53 acres. 3- That plaintiff is entitled to dower in said lands. 4- That the heirs of said intestate are the defendants, Lucy Griffin, wife of the defendant, John Griffin, Betsy Brinn, wife of the defendant Isaac W. Brinn, who are his sisters, the defendants Mary F. Wells, wife of the defendant Cooper Wells & Edny Ann Clark who are the children of Frank Clark, a brother of the intestate who died before him and the defendants William (Henry) Clark, Amanda Clark and Margaret Clark who are children of Henry Clark, a brother of the intestate who died before him the last five of whom are infants without guardian. Petition or Noah Bell and Rebecca, his wife, states that Charles Cromwell, the brother of Rebecca died in 1807 seized and possessed of a tract of land in Edge. Co. leaving Rebecca, Elisha Cromwell, Thence Taylor, Newsom Cromwell, and Bytha Cromwell, his heirs at law to whom the tract of land descended, Noah and Rebecca Bell, along with Bytha Cromwell, Elsa Taylor and Thence, his wife did agree to sell their shares of land to Elisha Cromwell for $120 for each one fifth share and Elisha paid to Bytha and Elsa Taylor and his wife, Thence their money but did not pay Noah and Rebecca Bell their $120 and they did not make title to land, said Elisha took possession of said land in the year 1808 and cultivated land and took profits from land until 1812 and he sold said land total of 4/5 of on 23 Mar 1812 to James Shirley, who sold land to John (Hansin) who now holds said land, said Elisha was otherwise indebted to said Noah Bell and said Noah was indebted to said Elisha by sundry notes bearing dates of 1807 and 1808, these two notes balanced each other, said Elisha died in Feb. 1812, and had not paid said Noah and Rebecca Bell for land, Redding Sugg was appointed administrator of said Elisha and sued said Noah for money owed under notes of 1807 and 1808 but did not pay for land, petition asks that Redding Sugg, pay $170 with interest from 23 March 1808.
