Permenter, James estate records 1789, petition of Margaret Permenter, widow of James Permenter, late of Edgecombe County, dec’d, stating that James, at the time of his death was possessed of a considerable personal estate and made his last will and testament on the 9th day of July 1789 and departed this life soon after without altering or revoking said will, James Permenter, his son was appointed one of his executors and took sole burden of the execution of estate, your petitioner and Joseph Pender, the other executor, relinquished their right of qualifying; said testator, James, made several bequests to his children and loaned to petitioner all the remaining portion of his estate “not before mentioned” during her natural life, (excepting) three negroes named Ben, Diniah & (Loudon) that she acknowledges that she has received but there were three head of horses, seven head of cattle, a quantity of leather {other personal items not listed here}, worth 150 pounds and upwards which have not been delivered to your petitioner and she asks court to issue a summons to said James Permenter, executor to appear before court on the next court (Feb 1795)and be required to deliver said items, signed Bl Baker for the Pltf. Proctor of Nash Co stating that his father, Jacob Proctor, late of Edge. Co died sometime in the year of 1859 or 60 leaving a last will and testament which was admitted for probate; that William Proctor, son of said testator was named executor in said will, it being declared that Orren Proctor, another son of said Jacob or this applicant, John Proctor should act as executor in case of the death of said William Proctor should not be living at testator’s death; Letters Testamentary were duly granted to said William Proctor who took possession of the testator’s property; said William died in the year 1867 and no executor or administrator has since been appointed upon said Jacob’s estate; in said will, testator devised to his wife, Temperance Proctor his home tract during her natural life or widowhood’ all remaining property was to be sold and the proceeds divided among his children, William, John, Aaron, Louisana and Martha and his five grandchildren, the children of his deceased daughter, Piety; that said tract, the only land the testator died seized and possessed of contained 164 acres in Edgecombe Co and was in the use of said Temperance from the time of his death until her death on 26 Dec 1879; said land is now valued at about $4 per acre; testator also devised to said Temperance during her life personal property which is now valued at about $40; said real and personal property will pass into the hands of administrator who is appointed; persons now (interested) in said estate are John J. Robbins, (Perlisha) E. Robbins, (Mascilles) Robbins, A.R. Robbins, Sally A. Robbins, ( ) B. Robbins, all of whom are infants except the first & sue by their guardian the said Patrick H. and of William Adams and wife, Mary vs. Richard H. Gattling, Jacob Robbins, late of said county died on Saturday before the last term of this court leaving a will in which the defendant Richard H. Gattling is named executor. None of the petitioners were aware of a will or that it had been entered for probate until after it was entered for probate and Gattling named executor. Mary, wife of William Adams is a daughter of said deceased, Jacob Robbins and the other petitioners are grandchildren of said Jacob Robbins by his deceased son, Jacob D. Robbins. Petitioners further state that the will entered for probate was not the last will of Jacob Robbins, because at the time the will was signed the said Jacob did not have sufficient mind to make a will. Petitioners further state that petitioners Patrick H. & Wm. Adams and wife are ignorant & illiterate persons & reside 17 to 20 miles from courthouse and that the other petitioners are infants without guardian. Petitioners ask that will be declared invalid. Williams, his wife, Sally A. Williams was a daughter of Jacob D. Robbins. On 1 Dec. 1875, she sold a lot of land descended from her father, lot # 4 in the division of his land to J.J. Sharpe in exchange for a tract of land in Nash Co. Sally died before signing deed, leaving two children, Frances Ella Williams and William Shelly (presumably Williams but not stated, possible child by former husband) as her heirs at law. Petition of Josiah Ellinor vs Wright W. Joyner states that John Robbins died in the year 1819 after making a will. John Mercer and others were appointed as executors but Mercer alone took the “burden of executing said will”. One item in will bequeathed “all the remainder of my Negroes be hired out until my grandchildren come of age & then to be sold & Equally divided amongst them.” This was done in 1826. In the pursuance of the bequest aforesaid in the year 1826 a division was made between & amongst the grandchildren of the testator by commissioners returnable to Feby Sessions 1826 by which division the shares of Warren Barnes, William Barnes, Evelina and George W. Amason children of Nancy Robbins the daughter of the testator were allotted their share of the Negroes of the deceased Catharine Williams, daughter of (Rode) Robbins daughter of the testator was allotted her share of said negroes- Patsy Pender then of full age was allotted her share of said Negroes she being a daughter of Elizabeth Pender who was a daughter of the (petitioner had been written but scratched out) testator and that the following Negroes to wit Dublin, Fanny Moses Rose Lettice and Presturn having to pay the Barnes aforesaid $88 and $20 to Thomas Amason on account of his daughter Evelina, were allotted to John Andrew Nancy & James Pender children of Elizabeth aforesaid as tenants in common that John Pender is now of full age & has taken into his possession a part of said Negroes & the remainder have been taken into possession of Wright W. (Joining) as guardian of Andrew & James & Nancy Pender & have been hired out as such by him”; petitioner Josiah Ellinor intermarried with Nancy Pender in the year (1811) and that the said Nancy died some time thereafter that and petitioner was appointed administrator of said Nancy by the court and prays that Wright W. (Jorner) as guardian be summoned to next court on fourth Monday of May next and answer several matters and whether as guardian he did not receive the Negroes allotted to John Andrew & James Pender & Nancy the former wife of your petitioner and that John Pender who is now of full age be summoned to answer the several matters aforesaid, how many of Negroes he received, their value and yearly hire and your petitioner prays that disinterested commissioners be appoint to divide the Negroes above named between John Andrew and James Pender together with your petitioner , signed (illegible, not Josiah). Ct. in 1850 and she disputed said will in manner required by law; said Simon died seized and possessed of a tract of land on the north side of Toisnot Swamp adjoining the lands of Augustine Farmer, John Batts, Arthur Robbins, and others supposed to contain 330 acres and another tract of land adjoining the lands of Augustine Farmer, William L.
