Gray, suit against Martha Ann Gray, Mary E. Gray, William Frances Gray, Caroline Gray, Virginia Gray, Ellen B. Gray, the last three being infants of tender years without guardian, Etheldred Gray, late of Edge. Co depart this life in March of 1846 after making a will which was proved at May Ct last and William Norfleet qualified as executor, petitioner descents from said will stating that Etheldred Gray died seized and possessed of the following land in Edgecombe Co, to wit, one tract on southeast side of Raleigh and Wilmington RR containing about 40 acres, a portion being in the village called Rocky Mount consisting of purchases made from Thomas Newby, Howell Braswell and wife, and Dorsey Battle; another tract adjoining the lands of Amanda Thomas, Dorris Brake and others containing 449 acres, the said Etheldred Gray being a tenant in common with James Battle in equal shares of the last mentioned tract; Etheldred Gray left the above mentioned defendants who are his children as his heirs at law; petitioner is entitled to her dower from said lands and is petitioning for said dower and asks court to allot same; Martha A. Gray, Mary Elway, William F. Gray, and Jno. Norfleet, guardian ad litim accept service of said petition. DOWER LAND LAID OFF for Patsey D. Gray in the lands that her late husband died seized and possessed of, two acres which he purchased of Thomas Newby, one acre called the Proctor lot and nine acres off of the tract he purchased of Howell Braswell and wife, leaving out three acres on the east end of said tract which makes 12 acres in the whole, including the dwelling house where the said deceased most recently dwelt next before his death, 10 Feb 1847, signed Whitmel Williams, Absalom Proctor (X), (W.A) Pope, Henry Ricks, Richard H. Battle, M. Weston, (John Barker), J.L. Boon (X), Thomas Newby, Dorris Brake, William Gay, D. Fergurson. PETITION TO DIVIDE, 20 Oct 1869, Martha Ann Howell, Mary E. Gray, William Francis Gray, and James H. Chapman and wife, Helen B. plaintiffs vs Caroline G. Bonner, infant over 14 years of age to whom John Norfleet is guardian and William C. Woodard, infant 14 years of age without general guardian, defendants; petition to court stating that Etheldred Gray died in Edge. Co leaving a will which devised all his real estate to his children, to wit, Martha Ann Gray, Mary E, William Francis, Caroline, Virginia, and Helen B to be equally divided between them when the youngest, the said Helen B. should attain the age of 16 years; plaintiff Martha A. has since wed to James D. Howell who has since died, Mary E. and William Francis have never married, Caroline subsequently married one Charles C. Bonner and has since died, leaving surviving her, her husband and a child, the said Carolina G. Bonner, one of the defendants, who is an infant about 18 years of age to whom John Norfleet is guardian, the said Virginia subsequently married one C.W. Woodard and has since died, leaving surviving her, her said husband and a child, William C. Woodard, one of the defendants who is an infant about 2 years old without guardian, the said Helen married one James H. Chapman and they are two of the defendants; the said CC. Bonner and C.W.C. Woodard have each released their interest as tenants by the by the curtsey in the said real estate to their said children separately; deceased was possessed at the time of his death of 36 acres at Rocky Mount Depot adjoining the land of W.W. Parker, Malachi Weston, (B.? ???), and the lands of which Gray Armstrong died seized which are situate the Rocky Mount Hotel buildings and a stone house and an undivided one half interest in a tract of land adjoining the lands of R.S. Petway, Hartwell Long and others containing (356 or 556) acres, the other half interest which belonged to one James S. Battle and said land was divided so that a tract of 241 acres was allotted to the devisees adjoining the lands of said R.S. Petway and others (Db 24, page 632); the said Helen B. attained the age of 16 years several years ago and the plaintiffs desire partition of said real estate but due to the small size of each portion would like a sale of land and division of proceeds, signed W.(H) Johnston, attorney for plaintiffs. RECEIPT for sale of land for $6760 signed by Martha A. Howell, Mary E. Gray, William F. Gray, Helen B. Chapman (NOTE: VERY HARD TO READ). Plat of this property shows division into two portions, part #1 beginning at a post oak Wright Braswell corner in William S. (Battle) line running north 239 poles to R.S. Petway's corner then along his line east 70 poles to another corner of said Petway then along his line south 239 poles then west 70 poles to the beginning containing 127 acres; tract #2 beginning at a lightwood stake William S. (Battle's) corner then south along his line 290 poles to a small post oak the said W.S. Petway's corner again then east 70 poles to a black gum corner then north 290 poles then west 70 poles to the beginning containing 136 acres, signed (R.S. Petway), Surveyor, 23 Dec 1869.
