Winstead. Judgement Feb. Ct. 1906, J.R. Uzzell, exe. of Mary Jackson vs. Cicero Culpepper et. al. Mrs. Maggie Culpepper is only heir and next of kin of Mary Jackson, dec'd. Mary Jackson had raised Lillie Winstead, wife of Frank Winstead but she was not a blood relative and not legally adopted. Maggie Culpepper was legal heir. No relation given. Wilson Co. Daughtridge, guardian of Emma Bullock, Annie Jackson, Minerva Jackson and Loula Jackson stating that he qualified as guardian 23 Jan 1896 and resources allotted for his wards is not sufficient for their support; wards have 11 vacant lots that produce no income but require that taxes be paid. Petitioner asks that court order lots to be sold for needed cash or petitioner be allowed to improve lots with other money in his hands so that lots will provid more income for said wards and that additional $25 annually be used for expenses for each of said wards, signed Battle & Thorne, attory for petitioner. AFFIDAVIT of Lindsey Boon stating that he is uncle of Emma Bullock, Annie Jackson, Minerva Jackson and Loula Jackson and, having formerly been their guardian, understands their circumstances; the interest on the money due them in the hands of their guardian, Z. Daughtridge is inadequate to meet their essential needs and they are in destitute conditions. Unless some portion of the principle of money is assigned to them, they will be dependent upon the charity of their friends for support. NEWSPAPER CLASSIFIED AD, SALE OF LAND; By virtue of the decree of the Superior Court of Edgecombe County made in the special proceedings therein pending, entitled "T.L. Worsley vs Mattie Luper, et als," I will on the 24th day of November, 1908 at 11 a.m. in front of the court house door in the town of Tarboro, sell at public auction for cash the following described lot of land, situated in the County of Edgecombe, State of North Carolina, known as lot No. 4, in the division of the real estate of O.L. Jackson, deceased and described by me as follows: Beginning at a stake in the line of lot No. 3 then north 5 degrees east 6 chains and 23 links to a stake corner of lot No 2, A. Gray's corner then with A. Gray's corner north 2 15 east 6 chains and 31 links to a stake J.W. Jackson's corner, thence with said Jackson's line south 85 east 3 chains and 5 links to a stake corner of lot No. 5, thence with the lines of lots No. 5 and No 3 North 86 30 west 2 chains and 75 links to the beginning, containing 3-50-10 acres. Dated 22 Nov. 1908. PETITION of H.C. Joyner, William Shaw and wife, Lillie Shaw, Gertrude Joyner, J.A. Bullock and wife, Lissie Bullock, Berger Joyner and Mrs. Rebecca J. Joyner, vs Lula May Joyner, Elisha Joyner, Katherine Joyner, Ethel Joyner and Gold Joyner, stating that plaintiffs and defendants are all tenants in common of the following described parcel of land in Edgecombe County TWP 12 beginning at a stake in J.W. Jackson's line, corner of lot No 8 thence with said Jackson's line south 85 east 3.72 chains to a stake, corner of lot # 10, thence with the line of lot No 10 south 5 west 43.95 chains to a pine, pine pointers in M.S. Proctor's line then with said Proctor's line north 53 west 4 chains, 40 links to a pine, gum, bay and pine pointers, corner of lot No 8, thence with the line of lot No 8 north 5 east 41 chains, 60 links to the beginning, containing 16 acres and being lot No 9 in the division of the O.L. Jackson land allotted to Mrs Rebecca J. Joyner (Ref Book 86, page 66); the above named plaintiff, Mrs. Rebecca J. Joyner owns a life estate in the whole and plaintiffs, H.C. Joyner, Lillie Shaw, Gertrude Joyner, Lissie Bullock and Berger Joyner, with the five defendants above named own one tenth equal interest each in the remainder; said land arises to the parties plaintiffs and defendants through their common ancestor, O.L. Jackson, who died on June 9, 1899 (sic), a resident of Edge. Co and by his last will left the land to his daughter, Mrs Rebecca J. Joyner for her life and then to her children; of said tenants in common the defendants, Lula May Joyner, Elisha Joyner, Katherine Joyner, Ethel Joyner and Gold Joyner are all minors and their mother, Mrs. Rebecca J. Joyner is their guardian; a partition of the land cannot be made without injury to all parties owing to the size of the said tract and a sale would be more advantageous than actual partition; Mrs Rebecca J. Joyner asks that she be paid the amount of her interest as provided by NC law; a sale of the lands privately has been negotiated to William Shaw, one of the plaintiffs for the price of $300 which represents the full value of said land as shown by the affidavits of three disinterested free holders; because of costs, a sale at public auction would derive less than the amount of private sale and plaintiffs ask that court order a direct sale of said tract. JACKSON, William estate, 1805, ORDER TO SHERRIFF OF EDGECOMBE COUNTY to bring Mathew Cary Whitaker, executor of the last will and testament of William Jackson, to court on the fourth Monday in November next to answer Christopher Ing of plea that he render unto him the sum of $100 dollars of the value of 56 pds which he unjustly detains to his damage ten pounds, signed E. ORDER TO SHERIFF OF HALIFAX COUNTY to take from the goods and chattels, lands and tenements of William Jackson in the hands of Matthew Whitaker, Executor 56 pds, 10 shillings which Christopher Ing recovered in Edgecombe Court, also the sum of 3 shillings & 9 pence and your own fees for this service and have monies in Edgecombe court on the fourth Monday in May next, dated 23 Feb 1807. Appears to be marked on folder 3pds 9 pence for Edgecombe expenses, 56 pds, 10 shillings for judgement and 28 pds, 8 shillings, 3 pence by Halifax expenses, dated 1807. NOTE: THERE APPEAR TO BE SEVERAL ORDERS FOR THIS SAME 56 PDS, 10 SHILLINGS IN FILE. Edgecombe Co Will, CR.037.508.65, abstracted 10-24- 05, CTC. JACKSON, W.T. estate, 1917; PETITION of W.A. Jackson, Miss Mollie Jackson, A.J. Todd and his wife, Rosa Todd, William Womble and his wife, Ellie Womble, T.A. Jackson and Geo. W. Jackson, a lunatic appearing herein by his guardian, T.A. Jackson, ex parte, stating that petitioners are tenants in common of a parcel of land about 2 miles from Rocky Mount in TWP 12 known as lot #5 in the partition of the land of John W. Jackson, deceased, being the lot assigned to the children of W.T. Jackson, containing 11 ½ acres; there are no houses or buildings on said land and $500 is a fair and reasonable value thereof; all parties are of full age but Geo. W. Jackson is a lunatic, now living in the State Hospital at Raleigh and his brother, T.A. Jackson has been regularly appointed his guardian by the Clerk of Nash Co. Superior Court; J.C. Jackson, acting for himself or some other person has offered to pay to this special proceeding the sum of $500; the land is valued at $500 but it is necessary to get authority of the court to sell the interest of Geo. W. Jackson, petition asks court to authorize T.A. Jackson to convey the interest of Geo. W. Jackson, signed J.J. Thorpe, Attorney. T.A. Braswell stating that he is familiar with the said land and the proper valued of land is $500, signed W.M. Braswell. Oct 27, 1917. A.W. Arrington, N.P. ORDER in the matter of W.A. Jackson, Miss Mollie Jackson, A.J. Todd and his wife, Rosa Todd, William Womble and his wife, Ellie Womble, T.A. Jackson and Geo. W. Jackson, a lunitic appearing herein by his guardian, T.A. Jackson, ex parte; this special proceeding to be heard before the Clerk of Superior Court of Edgecombe Co. in Tarboro on 31 Oct 1917, and being heard and the verified petition filed by petitioners and the court finds (1) that $500 is fair and reasonable value of the lot or block of and described in paragraph one of the petition and that the interest of the parties to this special proceeding is correctly set out; (2) it is in the interest of all parties including Geo. W. Jackson to sell said land for $500 in cash; it is ordered that T.A. Jackson, guardian of Geo W. Jackson is empowered on the payment of $500, one sixth of which belongs to Geo. W. Jackson to join with the other parties in the execution of a deed in fee conveying all the estate owned by Geo. W. Jackson; cost of this proceeding is $30 to be paid by J.C.
