State of North Carolina, County of Edgecombe, John Lancaster, Administrator of Prudence Lancaster, plaintiff vs. David Lancaster, James W. Lancaster, Polly Moore, Hansel Moore, Nancy Taylor, Martha Bullock, Jonathan Bullock, Dossey Lancaster, Wilson Lancaster, Jesse Lancaster, Louisa P. Lancaster, and Lancaster, an infant child of Willie Lancaster whose christian name is unknown, defendants. Petition for sale of Real Estate for Assets. The defendants Hansel Moore, Polly Moore, Dossey Lancaster, Wilson Lancaster, Louisa P. Lancaster, Jesse Lancaster, and Lancaster, infant child of Willie Lancaster, dec’d. whose christian name is unknown, all of whom reside beyond the limits of this state, are hereby notified to be and appear before the Clerk of the Superior Court of Edgecombe County at his office in Tarboro within 80 days from the date hereof and answer the petition of the Plantiff, a copy of which is deposited in the office of the Clerk Of the Superior Court for said county, and let them take notice that if they fail to answer the said petition within that time the Plantiff will apply to the Court for the relief demanded in the complaint, by order of the Superior Court. PETITION of John Lancaster, Administrator of Prudence Lancaster against David Lancaster, Dossey Lancaster, a non resident of this state, James Lancaster, Polly Moore, wife of Hansel Moore, a non resident of this state, Nancy Taylor widow of A.D. Taylor, Martha Bullock, wife of Jonathan Bullock and the children of Willie Lancaster viz. Wilson Lancaster and Jesse Lancaster adults and non residents of this state and Lousia Prudence Lancaster, infant over fourteen years of age, a non resident of this state and without guardian in this state and Lancaster, name unknown, infant under fourteen years of age, a non resident of this state and without guardian in this state, petition shows that Prudence Lancaster died in Dec. 1867 intestate and that at Feb. Ct. 1868 of Pleas and Quarters, John Lancaster was appointed administrator; debts outstanding against estate of Prudence amount to about $750; personal estate of Prudence consists of a small quantity of household and kitchen furniture, and some crops and stock which has been sold by John Lancaster and brought the sum of $66.46 and there is no other personal property to sale to pay debts; that said Prudence by virtue of last will and testament of “Austin Whitehead” “took as devisee for life” (345) acres of land adjoining the lands of (F.M. Barnes), Anzy Braswell and others with remainder in fee to her four boys, David Lancaster, Dossy Lancaster, Willie Lancaster, and Robert Lancaster; that on the 14 day of Feb. 1849, Willie Lancaster sold to Prudence Lancaster tenant for life his one fourth remainder interest for the sum of $100 and that by virtue of this conveyance, intestate died seized and possessed of an undivided one fourth interest in said lands which is estimated as being worth $300; that said intestate left surviving her the following children and grandchildren who are her only heirs at law to wit: David Lancaster, Martha, wife of Jonathan Bullock, Nancy Taylor, widow of A.D. Taylor, deceased, all of Edgecombe Co., and James Lancaster of Wilson County (NC?), and Dossy Lancaster a resident of (Puckersville, Tippo County, Mississippi and Polly Moore, wife of Hansel Moore a resident of in the state of Mississippi, and the children of Willie Lancaster, deceased, viz. Wilson Lancaster and Jesse Lancaster adults and Lousia Prudence Lancaster, infant over 14 years of age and Lancaster infant, under 14 years of age (name unknown) all residents of , Mississippi, the last one without guardian as your petitioner is informed; petitioner states that personal estate is insufficient to pay debts and real estate needs to be sold to pay debts; 12 July 1869.
