Proctor of Nash Co stating that his father, Jacob Proctor, late of Edge. Co died sometime in the year of 1859 or 60 leaving a last will and testament which was admitted for probate; that William Proctor, son of said testator was named executor in said will, it being declared that Orren Proctor, another son of said Jacob or this applicant, John Proctor should act as executor in case of the death of said William Proctor should not be living at testator’s death; Letters Testamentary were duly granted to said William Proctor who took possession of the testator’s property; said William died in the year 1867 and no executor or administrator has since been appointed upon said Jacob’s estate; in said will, testator devised to his wife, Temperance Proctor his home tract during her natural life or widowhood’ all remaining property was to be sold and the proceeds divided among his children, William, John, Aaron, Louisana and Martha and his five grandchildren, the children of his deceased daughter, Piety; that said tract, the only land the testator died seized and possessed of contained 164 acres in Edgecombe Co and was in the use of said Temperance from the time of his death until her death on 26 Dec 1879; said land is now valued at about $4 per acre; testator also devised to said Temperance during her life personal property which is now valued at about $40; said real and personal property will pass into the hands of administrator who is appointed; persons now (interested) in said estate are John J. Proctor of Nash Co, Lousiana Williams of Toisnot, Wilson Co, who is a widow, Martha Landing, wife of Louis Landing of Edge. Co, the children of deceased son, William Proctor whose names are Jesse Proctor, (Louisa)Daws, wife of Gray Daws, ( ) Proctor, Lucinda Proctor, and ( ) Proctor, Charles Proctor, William Proctor, (Irvin) Proctor, (Edna) Proctor, then reside in Edge. Co and are all of full age except the last two whose guardian is Jno. N. Taylor, residing in Edge. Co, Aaron Proctor, son of the testator died unmarried intestate and without issue; The children of the testator deceased son Orren Proctor who are Della, Georgiana, wife of Frank Arrington, Bunyan, Cadmus & Lena who are all under age except Della and all reside in Edge. Co; John J. Killebrew of Edge. Co being the guardian of the said Orren Proctor’s minor heirs; this (affiant) John J. Proctor hereby renounces any right that he may have to qualify as his executor of his father’s estate and prays that John J. Killebrew may be appointed administrator de bonis, signed 19 Jan 1880, John J. Proctor. PETITION of James B.W. ( ) & his wife, Ellen, J.J. Sessoms & wife, Edy, W.F. Godwin & wife, Jane & Jacob Flora vs John J. Killebrew & Joshua Bullock state that Jacob Proctor died in the year 1859 6 60; William Proctor, his son qualified as executor at May Ct 1860; said William Proctor died about the year 1867 (without) having fully administered the estate; John J. Killebrew qualified as administrator on 27 Jan 1880 to complete administration of estate of Jacob Proctor and entered into bond for $1400 with Joshua Bullock as suritor; said John J. Killebrew filed his final report on 29 Apr 1882 and estate had value of $1176.25; said plaintiffs, Ellen (Norville), Edy Sessums, and Jacob Flora are the only surviving children of Piety Proctor who was a child of testator, Jacob Proctor and are each entitled to 1/24th part of said $1176.25; signed Philip Staton, atty for plaintiffs (PETITION FAINT AND VERY HARD TO READ).
