Petition of Josiah Ellinor vs Wright W. Joyner states that John Robbins died in the year 1819 after making a will. John Mercer and others were appointed as executors but Mercer alone took the “burden of executing said will”. One item in will bequeathed “all the remainder of my Negroes be hired out until my grandchildren come of age & then to be sold & Equally divided amongst them.” This was done in 1826. In the pursuance of the bequest aforesaid in the year 1826 a division was made between & amongst the grandchildren of the testator by commissioners returnable to Feby Sessions 1826 by which division the shares of Warren Barnes, William Barnes, Evelina and George W. Amason children of Nancy Robbins the daughter of the testator were allotted their share of the Negroes of the deceased Catharine Williams, daughter of (Rode) Robbins daughter of the testator was allotted her share of said negroes- Patsy Pender then of full age was allotted her share of said Negroes she being a daughter of Elizabeth Pender who was a daughter of the (petitioner had been written but scratched out) testator and that the following Negroes to wit Dublin, Fanny Moses Rose Lettice and Presturn having to pay the Barnes aforesaid $88 and $20 to Thomas Amason on account of his daughter Evelina, were allotted to John Andrew Nancy & James Pender children of Elizabeth aforesaid as tenants in common that John Pender is now of full age & has taken into his possession a part of said Negroes & the remainder have been taken into possession of Wright W. (Joining) as guardian of Andrew & James & Nancy Pender & have been hired out as such by him”; petitioner Josiah Ellinor intermarried with Nancy Pender in the year (1811) and that the said Nancy died some time thereafter that and petitioner was appointed administrator of said Nancy by the court and prays that Wright W. (Jorner) as guardian be summoned to next court on fourth Monday of May next and answer several matters and whether as guardian he did not receive the Negroes allotted to John Andrew & James Pender & Nancy the former wife of your petitioner and that John Pender who is now of full age be summoned to answer the several matters aforesaid, how many of Negroes he received, their value and yearly hire and your petitioner prays that disinterested commissioners be appoint to divide the Negroes above named between John Andrew and James Pender together with your petitioner , signed (illegible, not Josiah).
