Braswell, Martha E. Braswell, Rufus H. Braswell, Mary E. Braswell, and Louisa D. Braswell, the last four being infants, suing by their guardian, Thomas N. Newby and Mary E.A. Thomas by her guardian, Robt. R. Bridgers state that Mary Whitehead died intestate and possessed of a tract of land adjoining the lands of Gray Armstrong, the heirs of the late Duncan L. Braswell, and others on a branch known as Hornes Branch containing 49 acres; Roena, wife of Thomas N. Newby, Elizabeth, wife of David Bunn and Martha A. Braswell, widow of Howel Braswell are the children of the said Mary Whitehead and Mary E.A. Thomas in the daughter and only child of a deceased son , Jacob and Martha E. Braswell, Rufus H. Braswell, Mary A.E. Braswell and Louisa D. Braswell are the children of Mary (V or A) Braswell a deceased daughter and that they are the only heirs of Mary Whitehead. They further state that Thomas N. Newby and wife, Roena, David Bunn and wife, Elisabeth, Martha A Braswell and Mary E.A. Thomas are each entitled to one fourth of the said realty and that Martha E., Rufus H. and Mary A.E. and Louisa D. Braswell are each entitled to one fourth of one fifth of the said land, being the only land owned by said Mary at the time of her death. Robert R. Bridgers has been acting as guardian for Mary E.A. Thomas for many years and Thomas N. Newby has been appointed as guardian of the children of Mary Braswell. Land has no buildings or improvements and is farm land. Petition is to sell land. Whitmell Williams and Gray Armstrong make oath that they are acquainted with land and it is in best interest of heirs to sell land and divide proceeds.
